PresentaciónQuienes hemos tenido que trajinar con la realidad petrolera vene-
zolana hemos aprendido a distinguir entre la visión distorsionada
por un prisma político –la PDVSA «roja rojita» que nos trató de ven-
der quien dirigía nuestra casa matriz petrolera– y las propuestas
serias, cargadas de profesionalismo, que nos ofrecen los verdaderos
conocedores de nuestra industria.
PDVSA fue un verdadero semillero de profesionales brillantes a quie-
nes, en función de los méritos que iban acumulando, se les brindó la
oportunidad de formarse lo más exhaustivamente posible en aque-
llas áreas en las cuales se desarrollaba su carrera profesional. En la
medida en que iban ascendiendo a posiciones de mayor jerarquía, el
país no solo les brindaba oportunidades, sino que en contrapartida
se beneficiaba de los conocimientos y la experiencia de aquellos
hombres que quedaban dotados con el conocimiento y las capacida-
des necesarias para adoptar decisiones de enorme trascendencia.
«Meritocracia» fue el nombre bajo el cual se conoció aquella política
que tanto contribuyó a la formación de los profesionales de altísimo
nivel que transformaron a PDVSA en lo que llegó a ser: una de las
más importantes transnacionales petroleras del mundo.
Diego González es uno de esos hombres a quienes tanto debe Vene-
zuela. Su formación comienza como técnico profesional petrolero,
para después graduarse como ingeniero petrolero en la Universidad
del Zulia, en la Universidad de Tulsa, en Oklahoma, y posteriormen-
te en el IESA. Tiene, pues, una formación académica impecable.
A lo largo de su carrera ocupó importantes posiciones gerenciales
en diversas áreas dentro de la industria, fue consultor del Banco In-

tiplicar un valor de petróleo original de sitio por un exagerado fac-
tor de recobro (FR) de 19 %». Hasta ese momento el factor de recobro
que se venía utilizando era del 4,1 %.
Concluye González: «la mayor parte de las reservas de petróleo que
presenta PDVSA al país y al mundo, que corresponden a las de la
Faja del Orinoco, no cumplen con las Normas del Despacho de Pe-
tróleo y Minería de Venezuela ni con las regulaciones internaciona-
les, por lo tanto, no se pueden considerar reservas probadas».
No quiere eso decir que Venezuela no tenga abundantes reservas
probadas de petróleo. Estas últimas, que nadie pone en duda, supe-
ran las reservas probadas sumadas de México, Brasil, Colombia,
Argentina, Ecuador y Perú. Contamos con una base de reservas
más que suficiente para elevar nuestra producción a una cifra de al
menos cuatro millones de barriles diarios durante los próximos
treinta años.
Entre los muchos planteamientos en este escrito, me llama la aten-
ción el de la «ventana de oportunidades» que se le abre a Venezuela
para aprovechar la riqueza petrolera con la cual la naturaleza quiso
dotar al país:
«Los principales pronosticadores a nivel mundial, tanto institucio-
nes (IEA, EIA, OPEP, WEC, entre otros), como empresas (ExxonMobil,
Shell, BP), y más recientemente la Academia de Ciencias de Rusia,
estiman una participación del petróleo en la matriz energética
mundial entre el 23 % y 31,8 % para el 2035-2040, siendo el estimado
de la OPEP de 24,3 % para el 2040».
Venezuela tiene que aprovechar el lapso que aún le queda, pues, sin
duda, buena parte de nuestras reservas se quedarán para siempre
en el subsuelo. El petróleo como agente energético paulatinamente
irá perdiendo posiciones frente a otros menos contaminantes. En la
medida en que sean energéticamente más eficientes, otras fuentes
de energía irán desplazando su uso.
teramericano de Desarrollo y del Instituto Latinoamericano de In-
vestigaciones Sociales (Ildis), miembro del Consejo Académico de
Cedice Libertad y coordinador de su Centro de Estudios de Energía,
fue presidente del COENER y tiene una amplia obra publicada. Con
todos esos méritos acumulados, pasa a ser miembro correspon-
diente de la Academia Nacional de la Ingeniería y el Hábitat.
Ese es el sólido bagaje intelectual, profesional y académico que res-
palda esta obra de Diego González. En ella nos presenta una Pro-
puesta para relanzar la industria petrolera nacional, editada por Ce-
dice Libertad.
Es obvio que superado el actual modelo económico y político que
tanto daño le ha hecho a Venezuela, el país tendrá que hacer gran-
des esfuerzos para recuperar su principal industria, que se ha de-
gradado y ha caído en un marasmo inaceptable de incompetencia,
dogmatismo y corrupción. Hemos perdido incontables oportunida-
des. La producción petrolera del país se está viniendo a pique, con
importantes pérdidas de mercados que hemos remplazado por
otros donde no somos competitivos o en los cuales se ha pretendido
obtener un dividendo político conforme a la visión dogmática de
quienes nos gobiernan, en lugar de un dividendo económico que
hubiera podido contribuir a enrumbar al país por la vía del desarro-
llo y la superación de los problemas sociales.
El mérito de esta propuesta de Diego González es que dice la verdad
basado en cifras reales y en razonamientos técnicos.
Procede Diego González a desmontar el mito de que Venezuela tie-
ne las mayores reservas de petróleo del mundo. Por lo pronto, las
reservas probadas de la Faja del Orinoco lucen gruesamente so-
brestimadas.
El «gobierno no se cansa de decir que somos el país con mayores re-
servas de petróleo, sobre todo en la Faja del Orinoco»... «Es impor-
tante recordar que la cifra de reservas probadas de petróleo de la
Faja del Orinoco derivó de un capricho presidencial en 2007, de mul-

El gas natural tiene más futuro que el petróleo, porque aún siendo
un combustible fósil es mucho menos contaminante. Está «llamado
a reemplazar al carbón para la generación de electricidad, y en mu-
chos casos a los derivados del petróleo en el transporte. Como vi-
mos, Venezuela tiene inmensos recursos de este hidrocarburo».
Tenemos, pues, que actuar con premura, decisión y sensatez. Diego
González nos presenta en las páginas siguientes sus recomendacio-
nes para emprender ese camino por una vía racional y segura. Ana-
liza los cambios institucionales que hay que realizar, nos presenta
planes para «el muy corto plazo (The day after)», «el corto plazo» y «el
mediano plazo».
La Propuesta para relanzar la industria petrolera nacional que pre-
senta Cedice Libertad de la mano de Diego González, es una con-
tribución extraordinaria y de obligatoria lectura y análisis, no solo
para quienes tengan interés en conocer lo que ha ocurrido con la
industria petrolera venezolana, sino también para quienes nece-
sariamente tendrán la responsabilidad de ocuparse de su recons-
trucción.

1. Resumen Motivado por la necesidad de rescatar la industria petrolera nacio-
nal (IPN), en la coordinación de un grupo de profesionales vincula-
dos directa e indirectamente a esta, constituidos en el Centro de
Estudios de Energía de Venezuela (CEEV) de Cedice-Libertad, he
elaborado este documento con el propósito de promover discusio-
nes y acciones para lograr una industria petrolera en Venezuela po-
tenciada organizacional, tecnológica y financieramente, con inver-
siones públicas y privadas en beneficio de sus propietarios
legítimos, los venezolanos, y que contribuya a generar una dinámi-
ca socioeconómica que nos permita transitar la vía hacia un país
desarrollado.
Este documento tiene como objetivo inicial proponer acciones para
garantizar la seguridad energética, mediante medidas tendentes a
lograr la gobernabilidad y la normalidad operativa de PDVSA y del
resto de las empresas que conforman la IPN. Es parte de la premisa
el grave deterioro de nuestra principal industria y de la urgencia de
mejorar su eficiencia y eficacia, mediante un modelo diferente al
que existió hasta 1998 y al que existe actualmente. Por otra parte, el
tiempo ha puesto de relieve que el desarrollo del país basado sola-
mente en los ingresos de las divisas petroleras es absurdo e infla-
cionario; las fluctuaciones de los precios del crudo han ocasionado
repetidas crisis en lo presupuestario, en lo fiscal y en lo monetario.
Cuando los precios caen se imponen ajustes violentos que los go-
biernos no han sabido manejar, que deterioran el bienestar de la po-
blación, situaciones que se tratan de resolver aumentando la deuda
interna y externa (comprometiendo al país con potencias como
China y Rusia), disminuyendo las reservas del Banco Central, y ter-
minando por vender activos de la estatal PDVSA.

Otro aspecto a tomar en cuenta, es que si bien los derivados del pe-
tróleo siguen siendo la principal fuente de energía, es de visualizar
que en un plazo de 30 a 40 años perderá importancia relativa frente
al gas natural y las fuentes alternas. De allí la necesidad de desarro-
llarlo con eficiencia e invertir adecuadamente sus ingresos asegu-
rando el bienestar de las generaciones actuales y futuras. Cabe re-
saltar que es probable encontrarnos en el 2016 con un escenario
económico complicado, si el Gobierno sigue utilizando los recursos
del petróleo para efectos electorales populistas, dejando al país con
menos reservas, con lo que aumentarán los problemas de caja en la
estatal PDVSA y en el Fisco.
Dada la precaria situación de reservas del BCV y que el servicio de la
deuda pública será más elevado para el año 2016 y el siguiente, es
muy posible que el próximo gobierno vea disminuida su capacidad
de maniobra macroeconómica. Estamos estimando que las expor-
taciones de crudo deberán alcanzar no menos de 71.000 millones de
dólares para garantizar dichos pagos, las importaciones más indis-
pensables y los compromisos de PDVSA, cifra por demás inalcanza-
ble con la situación de los precios en lo que resta de 2015, y para el
2016; y ni hablar de elevar sustancialmente la producción para
compensar la situación de los precios.
Consideramos que cualquier acción orientada a abordar el futuro
de la industria petrolera nacional debe ser suficientemente discuti-
da con el país político y nacional, en el marco de una gestión hones-
ta, transparente y competitiva, de respeto a los trabajadores y en
procura de hacer del negocio petrolero un generador del máximo
bienestar para los ciudadanos y la nación. Recordándoles a los gru-
pos de interés que los hidrocarburos, en especial el petróleo, no tie-
nen nada de estratégicos, ni es una industria básica, y mucho me-
nos es sinónimo de soberanía, independencia y para el desarrollo
social –paradigmas creados por nuestra clase política, que se han
arraigado en el imaginario nacional.
Con los recursos y reservas ciertas de petróleo y gas natural con
que cuenta el país, es que se harán las propuestas para rescatar y
relanzar la industria petrolera nacional (IPN). Teniendo presente
que una cosa es tener recursos y aun reservas, y otra cosa estar en
la capacidad real de producirlas y comercializarlas, que es la trage-
dia de la mayoría de los países OPEP, en especial Venezuela, cuyo go-
bierno no se cansa de decir que somos el país con mayores reservas
de petróleo, sobre todo en la Faja del Orinoco, pero no logra aumen-
tar la producción. Es importante recordar que la cifra de reservas
probadas de petróleo de la Faja del Orinoco derivó de un capricho
presidencial en 2007. Por lo antes expuesto, la mayor parte de las re-
servas de petróleo que presenta PDVSA al país y al mundo, que co-
rresponden a las de la Faja del Orinoco, no cumplen con las Normas
del Despacho de Petróleo y Minería de Venezuela ni con las regula-
ciones internacionales, por lo tanto, no se pueden considerar reser-
vas probadas.
Si hoy el petróleo no se refina, no sirve para nada. Los principales
pronosticadores a nivel mundial, tanto instituciones (IEA, EIA, OPEP,
WEC, entre otros), empresas financieras, como empresas petroleras
(ExxonMobil, Shell, BP), y más recientemente la Academia de Cien-
cias de Rusia, estiman una participación del petróleo en la matriz
energética mundial entre el 23 % y 31,8 % para el 2035-2040, siendo
el estimado de la OPEP de 24,3 % para el 2040. Esto es lo que hemos
dado por llamar «La ventana de oportunidades para el petróleo ve-
nezolano». El gas natural tiene más futuro que el petróleo, porque
es el combustible fósil que menos contamina, y del que hay mu-
chos más recursos. Venezuela tiene inmensos recursos de este
hidrocarburo.
Con respecto a las reservas venezolanas, para cualquier efecto de
cálculos de producción, las reservas de las áreas tradicionales («cru-
dos convencionales») de 76.000 millones de barriles serían más que
suficientes. En esta cifra entran las 4 anteriores asociaciones de la
Faja. Sin embargo, considerando que hay varios colegas que dudan
de esas reservas desarrolladas y no desarrolladas para 1998, y siendo
conservador, sugiero para los cálculos la figura de 43.000 millones de

1. crear el Ente Regulador de los Hidrocarburos,
2. crear la Comisión Nacional de Energía, y
3. dar todos los pasos necesarios para tener un Ministerio de Ener-
gía moderno.
Se requerirá que desde el gobierno nacional se envíen al mundo se-
ñales de estabilidad y legalidad que generen confianza con respecto
a invertir y trabajar en Venezuela.
Es necesario promover y desarrollar, respondiendo a las condicio-
nes del mercado: la Faja Petrolífera del Orinoco, las reservas proba-
das no desarrolladas en áreas tradicionales, las áreas inactivas, las
áreas nuevas para exploración y futuro desarrollo, el gas costa
afuera, así como proyectos de gas natural licuado para exporta-
ción. Promover la creación de empresas para industrializar las co-
rrientes de refinación, así como nuevas petroquímicas. Habrá que
revisar, dentro de la ley, aquellos acuerdos internacionales que sean
lesivos al país.
Es necesario revisar la relación Estado-sociedad con respecto a la
renta que produce la actividad de los hidrocarburos, para que esta
vaya directamente a los ciudadanos.
Se deberán revisar los acuerdos y convenios bilaterales y acondicio-
narlos a los mejores intereses de la República; iniciar los procesos
para modificar la legislación en materia de hidrocarburos para faci-
litar la ejecución de los puntos antes mencionados.
Será preciso que PDVSA deje de ser una operadora y convertirla en
una excelente administradora de los contratos de producción com-
partida (Production Sharings), en nombre de los propietarios del re-
curso, todos los ciudadanos. Sobre lo anterior se tienen los extraor-
dinarios ejemplos de las Asociaciones de la Faja, donde PDVSA tenía
menos del 50 % de participación y todo marchaba exitosamente.
Mientras se cambia la Ley Orgánica de Hidrocarburos, con volun-
tad política, se puede usar la figura de las empresas mixtas para tal
fin, con los particulares teniendo por lo menos el 49 % de participa-
barriles, que para todos los efectos son más que las reservas proba-
das sumadas de México, Brasil, Colombia, Argentina, Ecuador y Perú.
Ese volumen de reservas probadas podría resultar en una produc-
ción cercana a los 4.000.000 b/d durante los próximos 30 años.
La cadena de valor de la IPN comienza en las actividades de Explo-
ración y Producción (EyP). En general, las discusiones y propuestas
en relación con la IPN giran habitualmente alrededor de las activi-
dades «aguas arriba», es decir, a las de EyP.
Después de las actividades de EyP le siguen las de manufactura de
los hidrocarburos producidos (refinación, mejoramiento de crudos
de la Faja, y procesamiento del gas natural); las de gas natural, si-
guen las de transporte y almacenamiento; las de comercio interno
y externo; las propiamente de mercado interno, y continúa con las
de investigación, desarrollo y adiestramiento, no menos importan-
tes, para terminar finalmente en los negocios en el exterior. Por Ley
todas estas actividades, con excepción de las de EyP, no están reser-
vadas al Estado, es decir, que pueden ser realizadas por el sector
privado «en conjunto o no con empresas del Estado», así reza nues-
tra legislación en materia de hidrocarburos.
Lo anterior significa que con voluntad política se abre todo un aba-
nico de oportunidades para el pleno desarrollo de la IPN con la parti-
cipación del sector privado, tanto nacional como internacional.
En toda la cadena de valor de la IPN, las oportunidades de negocios
son muchas. Por la sencilla razón de que todas las actividades, con
excepción de la de Exploración y Producción (EyP), no están reserva-
das al Estado. En Exploración y Producción en materia de petróleo
hay seis oportunidades principales, a corto y mediano plazo, aun
con la legislación actual; y en gas natural hay tres oportunidades
principales. Así también hay oportunidades en mercado interno, y
en comercio y suministro.
Cuando preguntamos qué cambiar, en lo institucional es necesario
acometer tres acciones prioritarias:

ción en los negocios. Para las actuales actividades que realiza PDVSA
como de esfuerzo propio se pueden firmar contratos de servicio.
Se deben tomar medidas en el corto plazo (the day after):
1. la estatal PDVSA debe mantener su actividad que hoy realiza
como «esfuerzo propio», actividad que produjo 1.764.400 b/d en
2014, es decir, el 60,9 % de la producción oficial; y las empresas
mixtas que produjeron 1.143.700 b/d, el 39,1 % de la producción
oficial que totalizó 2.899.100 b/d;
2. identificar el personal prioritario para garantizar la continuidad
de las operaciones;
3. Tomar control inmediato de los sistemas prioritarios de infor-
mación, tales como los operacionales, finanzas, comercio inter-
nacional y nómina;
4. Establecer un Plan de Comunicaciones Internas permanente,
que baje la incertidumbre en el personal y genere un clima propi-
cio a la continuidad operativa;
5. Realizar evaluaciones técnico-operacionales y de procesos ad-
ministrativos en las principales áreas del negocio y en los pro-
gramas de responsabilidad social;
6. Será necesario realizar una auditoría técnico-financiera, de re-
servas, del estado de los yacimientos e instalaciones, así como
evaluar rigurosamente la viabilidad de aumentar la producción;
7. Asegurar las instalaciones de alta criticidad tales como refine-
rías y llenaderos de combustible, gasoductos, plantas compreso-
ras de gas y centros de despacho de gas;
8. Contactar a la comunidad financiera nacional e internacional
para garantizar el cumplimiento de los compromisos de la em-
presa y asegurar que se mantengan los flujos de créditos para
una PDVSA debilitada financieramente;
9. Finalmente esta el tema del manejo de los recursos humanos ac-
tualmente trabajando en la estatal. En el 2002, PDVSA contaba
con una nómina de 39.354 trabajadores propios y 28.329 contrata-
dos y estaba en reducción. En la actualidad, según cifras del In-
forme 2014 de PDVSA, laboran 147.126 trabajadores, de los cuales
30.320 no están en actividades del sector, además hay 25.698
contratistas.
Desde el primer día, el Ministerio de Petróleo y Minería, conjunta-
mente con miembros de la directiva de PDVSA nombrados para tal
efecto, deben comenzar a dar los pasos necesarios para llevar a la
IPN a una situación de óptimo desarrollo y actuación. Para llevar
adelante lo anterior, se requiere lograr la Gobernabilidad y la Nor-
malidad Operativa de PDVSA y de las empresas mixtas.
2. Recursos y reservasCreemos que es importante extenderse en este tema, porque con
los recursos y reservas de petróleo y gas natural con que cuenta el
país, es que se harán las propuestas para rescatar y relanzar la in-
dustria petrolera nacional (IPN).
La regulación de los conceptos de recursos y reservas de petróleo y
gas natural data de muchos años, siendo los precursores la Ameri-
can Petroleum Institute (API), que en 1976 publicó el trabajo «Organi-
zation and Definitions for the Estimation of Reserve and Productive Capa-
city». A continuación, es la Sociedad de Ingenieros de Petróleo de los
EE.UU. (SPE) la más activa desde 1981 sobre el tema, cuando su revis-
ta técnica, Journal of Petroleum Technology, presentó las «definiciones
de las reservas probadas de petróleo». De allí en adelante su trabajo
ha sido permanente y consistente, hasta el reciente excelente tra-
bajo, de 221 páginas, de noviembre 2011: Guidelines for Application of
the Petroleum Resource Management System (PRMS), que coordinó, con
el apoyo de la Sociedad Americana de Geólogos Petroleros (AAPG), el
Consejo Mundial de Petróleo (WPC) patrocinantes del World Petro-

leum Congress, la Sociedad de Ingenieros para Evaluaciones Petro-
leras (SPEE) y la Sociedad de Geofísicos de Exploración (SEG).
El establecimiento del Sistema Gerencial de los Recursos Petrolífe-
ros (PRMS) a nivel mundial data de 2007. El tema de los conceptos y
las definiciones de los recursos y las reservas de hidrocarburos es
de tanta importancia que ha sido centro de la atención de las Nacio-
nes Unidas, institución que desde 2004 analiza el tema y lo publica
como United Nations Framework Classification for Fossil Energy and Mi-
neral Reserves and Resources 2009.
Así, la US Securities and Exchange Commission - SEC es la agencia regu-
latoria de los EE.UU. que desde 1934 tiene como Misión «proteger a
los inversionistas, y mantener los mercados de forma transparente,
ordenados y eficientes, para facilitar la formación de materias de
recursos y reservas de petróleo y gas natural, para proteger a los
accionistas de las empresas petroleras»; recordemos el caso de la
Royal Dutch Shell, a la que la SEC terminó con imponer una obliga-
ción enorme para la empresa (389 millones de US$) con sus accio-
nistas y la destitución de los directores responsables del cálculo y
presentación de esas reservas, que no eran tales. No es coincidencia
que PDVSA se haya retirado de la SEC.
Estos conceptos y definiciones internacionales de recursos y reser-
vas de petróleo y gas natural han sido recogidos por el ahora Minis-
terio de Petróleo y Minería de Venezuela en sus «Definiciones y Normas
de las Reservas de Hidrocarburos-Dirección de Exploración y Producción».
Una cosa es tener recursos y aun reservas y otra cosa estar en la ca-
pacidad real de producirlas, que es la tragedia de la mayoría de los
países OPEP, en especial de Venezuela, cuyo gobierno no se cansa de
decir que somos el país con mayores reservas de petróleo, sobre
todo en la Faja del Orinoco.
Es importante recordar que la cifra de reservas probadas de petróleo
de la Faja del Orinoco derivó de un capricho presidencial en 2007, de
multiplicar un valor de petróleo original de sitio (POES) de 1.360 mi-
llardos de barriles por un exagerado factor de recobro (FR) de 19 %,
que resulta en la cifra de 257,4 millardos de barriles. El triste origen
de ese alto factor de recobro lo expliqué en mi Barriles de Papel N.º 18
En la PDVSA democrática se estableció para la Faja un POES de 914
millardos de barriles y se declararon reservas probadas de 37,1 mi-
llardos de barriles, usando un moderado y más razonable FR de
4,1 % (Aníbal Martínez, 2004, La Faja del Orinoco, Editorial Galac).
Por lo antes expuesto, la mayor parte de las reservas de petróleo
que presenta PDVSA al país y al mundo, que corresponden a las de
la Faja del Orinoco, no cumplen con las Normas del Despacho de
Petróleo y Minería de Venezuela ni con las regulaciones internacio-
nales, por lo tanto, no se pueden considerar reservas probadas.
3. El futuro de los hidrocarburos en el mundoa. PetróleoDebemos recordar que hoy si el petróleo no se refina no sirve para
nada. De un proceso de refinación típico se obtiene de gasolina el
47 %, de Diesel y Fuel Oil el 23 % y de Jet Fuel o combustible de avia-
ción el 10 %, es decir, que el 80 % va al transporte. En la medida en
que el transporte sea atendido por las energías renovables y sean
energéticamente más eficientes, el transporte terrestre, embarca-
ciones y aviones necesitarán menos derivados del petróleo. Los
principales pronosticadores a nivel mundial, tanto instituciones
(IEA, EIA, OPEP, WEC, entre otros), como empresas (ExxonMobil, Shell,
BP), y más recientemente la Academia de Ciencias de Rusia, esti-
man una participación del petróleo en la matriz energética mun-
dial entre el 23 % y 31,8 % para el 2035-2040, siendo el estimado de la
OPEP de 24,3 % para el 2040. Esto es lo que hemos dado por llamar
«La ventana de oportunidades para el petróleo venezolano».
b. Gas naturalEl gas natural tiene más futuro que el petróleo, porque es el com-
bustible fósil que menos contamina, y del que hay muchos más re-

cursos (principalmente el gas en las lutitas y el gas de los hidratos
en los lechos marinos) y es el llamado a reemplazar al carbón para
la generación de electricidad, y en muchos casos a los derivados del
petróleo en el transporte. Como vimos, Venezuela tiene inmensos
recursos de este hidrocarburo.
4. Recursos y reservas de hidrocarburos en VenezuelaCon respecto a las cifras oficiales de reservas probadas de petróleo
y gas natural de Venezuela, la situación es crítica: al leer en el Infor-
me de Gestión 2014 de PDVSA enfatizan que de los enormes volúme-
nes de reservas probadas que se anuncian, apenas están desarro-
lladas (tienen la infraestructura para producirlas) las de petróleo
en 4 %, el resto necesita miles de nuevos pozos, nuevas estaciones
de recolección y plantas compresoras de gas, nuevos oleoductos y
gasoductos, nuevos patios de almacenamiento y muelles, es decir,
toda una infraestructura que suma billones de dólares, muy bien
diseñada y que debe estar a tiempo para que ese nuevo petróleo se
produzca.
Así mismo, según PDVSA, las reservas oficiales probadas de gas na-
tural son de 196 billones (1012) de pies cúbicos (tcf), pero están desa-
rrolladas en solo un 19 %. De estas reservas las ubicadas costa afue-
ra son 31,64 tcf, y a 11 años de promulgada la Ley Orgánica de
Hidrocarburos Gaseosos todavía no sale una producción sustancial
de gas natural de esos campos, para ser vendido en el mercado in-
terno, y menos para exportarlo; y escuchamos que la producción de
la Plataforma Deltana irá a Trinidad-Tobago para ser procesada. Y
los recursos de gas natural por explorar y desarrollar en tierra y
costa afuera suman 200 tcf.
Con respecto a las reservas venezolanas, en los Cuadros N.º 1 y 2
explicamos que para cualquier efecto de cálculos de producción las
reservas de las áreas tradicionales («crudos convencionales») de
76.000 millones de barriles serían más que suficientes. En la cifra
anterior entran las cuatro Asociaciones de la Faja con un factor de
recobro moderado y producible. Sin embargo, considerando que
hay varios colegas que dudan de esas reservas desarrolladas y no
desarrolladas a 1998, y siendo conservador, sugiero para los cálcu-
los la figura de 43.000 millones de barriles, que para todos los efec-
tos son más que las reservas probadas sumadas de México, Brasil,
Colombia, Argentina, Ecuador y Perú. Ese volumen de reservas pro-
badas podría resultar en una producción cercana a los 4.000.000
b/d durante los próximos 30 años.

Específicamente, en relación a la infraestructura de refinación, con
el debido mantenimiento y haciéndole las mejoras necesarias, las
seis refinerías nacionales e Isla para efectos de la «seguridad ener-
gética» pudieran abastecer el mercado nacional y quedaría algo
para exportar. Las cifras de reservas ajustadas pueden satisfacer
con creces los requerimientos de estas. Más detalles en el cuadro 3.
La administración de las refinerías será un capítulo aparte, así co-
mo los otros negocios antes mencionados.

6. La industria petrolera nacional (IPN) en cinco tiemposPara cualquier análisis del futuro de la IPN, hay que ir a su pasado in-
mediato, tratando de ubicar a la estatización de la IPN (1975) en el
marco de la producción de petróleo del país desde 1970. La estatiza-
ción ocurre a los cinco años del mayor auge de producción y estuvo
en una caída libre de la misma durante 15 años (1971-1985), caída que
se intentó recuperar hasta 2001, cuando se alcanzó el nivel de pro-
ducción de 1973, y los planes apuntaban sobrepasar el nivel de 1970.

5. El resto de la cadena de valor de la industria petrolera nacional (IPN)
La cadena de valor de la IPN comienza en las actividades de Explo-
ración y Producción (EyP). En general las discusiones y propuestas
en relación con la IPN giran habitualmente alrededor de las activi-
dades «aguas arriba», es decir, a las de EyP.
Después de las actividades de EyP le siguen las de manufactura (re-
finación, mejoramiento de crudos de la Faja, y procesamiento del
gas natural), de los hidrocarburos producidos; las de gas natural, si-
guen las de transporte y almacenamiento; las de comercio interno
y externo; las propiamente de mercado interno, y continúa con las
de investigación, desarrollo y adiestramiento, no menos importan-
tes, para terminar finalmente en los negocios en el exterior. Por ley
todas estas actividades, con excepción de las de EyP no están reser-
vadas al Estado, es decir, que pueden ser realizadas por el sector
privado «en conjunto o no con empresas del Estado», así reza nues-
tra legislación en materia de hidrocarburos.
Esto significa que con voluntad política se abre todo un abanico de
oportunidades para el pleno desarrollo de la IPN con la participa-
ción del sector privado, tanto nacional como internacional. Tema
del que nos ocuparemos posteriormente.

1. Política de no más concesiones, formulada desde 1945.
2. En 1945-1948, con la reforma fiscal, la Junta Revolucionaria de
Gobierno establece la figura del 50 %-50 % para distribuir las
ganancias entre las concesionarias y el Estado. Esta relación se
elevaría a lo que fue conocido como el 60 %-40 %, con la reforma
impositiva de la Junta de Gobierno de 1958.
3. El 9 de abril de 1959 se crea la Comisión Coordinadora de la Con-
servación y el Comercio de los Hidrocarburos, para la defensa de los
precios y para evitar el despilfarro económico del petróleo (Juan Pablo Pé-
rez Alfonzo-JPPA).
4. El 19 de abril de 1960 se crea la petrolera estatal Corporación Ve-
nezolana del Petróleo (CVP), una empresa nacional manejada por ve-
nezolanos, para los venezolanos (JPPA), adscrita al Ministerio de Mi-
nas e Hidrocarburos.
5. El 20 de julio de 1967 se reforma la Ley de Hidrocarburos de 1943
para introducir la figura de los Contratos de Servicio negociados
por el Ministerio de Minas e Hidrocarburos o la CVP.
6. El 11 de febrero de 1969 se sanciona el Reglamento sobre la Con-
servación de los Recursos de Hidrocarburos, por lo demás, un do-
cumento estrictamente técnico de primera calidad.
7. El 11 de abril de 1969 la Sociedad Venezolana de Ingenieros de Pe-
tróleo (SVIP) realiza un exitoso Foro sobre la Reversión de las Conce-
siones Petroleras, a partir de 1983.
8. En 30 julio de 1971 el presidente Rafael Caldera promulga la Ley de
Bienes Afectos a Reversión en las Concesiones de Hidrocarburos. Se pre-
paraba al país para adelantar la fecha de la reversión de la mayo-
ría de las concesiones.
9. El 26 de agosto de 1971 el presidente Rafael Caldera promulga la
Ley que Reserva al Estado la Industria del Gas Natural, que obligaba a
las empresas concesionarias a entregar a la CVP todo el gas natu-
Cuando llega la estatización en 1975, el país cerró con una produc-
ción promedio para este año de 2.346.202 b/d, aunque en el mes de
diciembre de ese año estuvo en 1.772.000 b/d… ¿cosas de la estati-
zación?
A partir de 1970 y hasta 1985, cuando apenas se produjo un prome-
dio para el año 1985 de 1.681.045 b/d, todo fue ver caer la produc-
ción… ¿Qué pasó en esos 15 años?… ¡solo vimos caer la producción!
Sería en 1997 cuando de nuevo se vería una producción por encima
de los tres millones de barriles diarios. Para ser exactos, ese año el
promedio fue de 3.160.000 b/d, para llegar en 2001 al último tope de
3.342.000 b/d. Desde 2002 y hasta la fecha, no se ha vuelto a ver ele-
varse la producción. Para el 2014 la estatal PDVSA reporta una pro-
ducción promedio de crudo de 2.779.000 b/d, aunque las fuentes
OPEP dicen que fue solo de 2.373.000 b/d. Para el mes de septiembre
2015 la estatal PDVSA reporta a la OPEP una producción promedio de
crudo de 2.630.000 b/d, aunque las fuentes secundarias OPEP dicen
que fue solo de 2.369.000 b/d.
Estos cambios en los niveles de producción de petróleo irán a afectar
los niveles de producción de gas natural (por ser esta asociada al pe-
tróleo), la manufactura y el procesamiento de petróleo y gas natural,
así como las exportaciones, y por supuesto, las finanzas de la IPN.
El 29 de agosto de 1975 el presidente Carlos Andrés Pérez Rodríguez,
firma el «cúmplase» de los 28 artículos contentivos de la Ley que
Reserva al Estado la Industria y el Comercio de los Hidrocarburos,
ley que se haría efectiva a partir del 1.º de enero de 1976. El 30 de
agosto de 1975, por Decreto N.º 1123 se creó PDVSA.
A esta decisión, más política que cualquier otra cosa, se llegó des-
pués de once notorios procesos estatizadores. Decimos que fue po-
lítica y no económica porque el PODE 1975 (pág. 128) informa que la
relación participación del Estado con respecto a la utilidad de las
empresas fue del 94 %; y la suma del ISLR, las regalías y otros im-
puestos sumó 6.785,9 mmUS$, es decir, el 78,64 % del ingreso total
de las empresas (8.628,6 mmUS$). Estos hechos fueron:

ral producido; y el Ejecutivo decidía cualquier uso del mismo en
las operaciones de producción (combustible, inyección, procesa-
miento, etc.) .
10. El 28 de enero de 1973 el ministro de Minas e Hidrocarburos
anuncia que la Faja Petrolífera del Orinoco no será negociada con
ninguna nación y que todos los futuros desarrollos petroleros
nacionales los realizará la CVP, y
11. El 21 de junio de 1973 se promulga la Ley que Reserva al Estado la Ex-
plotación del Mercado Interno (MI) de los Productos Derivados de los Hi-
drocarburos, con la cual toda la actividad del MI será manejada por
la estatal.
En 1975 las reservas probadas de petróleo, al cierre del año, eran de
18.511 millones de barriles. En el año se produjo un promedio de
2.346.202 b/d de petróleo, de una gravedad promedio de 25,9 oAPI, es
decir, a los niveles de 1956. De ese volumen, el 38,5 % era de 30,1 oAPI
o más (liviano y condensado), el 34,5 % entre 22,1 y 30 oAPI (media-
no) y el 27,1 % restante era menor de hasta 22,0 oAPI (pesados y ex-
trapesados).
Las 12 refinerías en operación tenían una capacidad de procesa-
miento de 1.554.000 b/d de operación. Se procesaron 865.855 b/d de
crudos y mezclas, y la exportación de petróleo (1.472.178 b/d) y pro-
ductos (613.970 b/d) fue de 2.086.148 b/d. El consumo de gasolinas
fue de 105.286 b/d. Las exportaciones ocurrieron a un precio reali-
zado de 10,99 US$/barril para el petróleo y 11,0 US$/barril para los
productos.
Del total de ingresos fiscales ordinarios (9.738 mmUS$), 7.535
mmUS$ fueron provenientes del petróleo, es decir, el 77,4 %, así el
95,6 % de las exportaciones (pág. 1, PODE, 1975).
El personal de la IPN en 1975 totalizó 23.733 empleados, de los cuales
23.248 eran nacionales y 485 extranjeros. El promedio de remune-
ración anual en 1975 fue de 1.948,4 millones de bolívares, es decir,
82.097 Bs. anuales por empleado, que a la tasa de cambio para 1975
de 4,20 Bs./US$ serían 19.546,9 US$ anuales por empleado.
2001 es el año en que la producción de petróleo cierra en su más
alto nivel después de la estatización; se produjo un promedio para
el año de 3.342.000 b/d, es decir, a los niveles de 1963-1964, con una
gravedad promedio de 23,5 oAPI. De ese volumen, el 43,6 % era me-
nor a 21,9 oAPI (pesado y extrapesado), el 35,1 % estaban entre 22,0 y
29,9 oAPI (mediano) y el 21,3 % era de 30,0 o más oAPI (liviano y con-
densado). Se observa cómo se había reducido la calidad de la pro-
ducción con respecto a 1985. Para 2001 la producción de los Conve-
nios Operativos era de 502.011 b/d y la de las cuatro Asociaciones de
la Faja del Orinoco 233.200 b/d (los mejoradores entraron a partir de
febrero de 2001). Las reservas probadas de petróleo, al cierre del año
2001, eran de 77.783 millones de barriles.
En el período 1999-2014 el aumento de las reservas de los crudos
«convencionales» es muy modesto, el aumento extravagante solo se
atribuye a los crudos extrapesados, en especial del Campo Faja del
Orinoco. En 1998 se contabilizaban 35.647 millones de barriles
(mmb) de esas reservas, mayormente de la Faja, reservas que co-
rrespondían a las cuatro Asociaciones Estratégicas y a los Bitúme-
nes de Bitor. Para 2014, el incremento de las reservas de la Faja es
desmedido, que por lo demás no son reservas, como se explicó an-
tes. Por esta razón mi propuesta es que ese exagerado número no se
considere para cálculo alguno, ya que en cualquier caso, la cifra de
76.000 mmb, es más que suficiente para efectos de producción. De-
talles en el cuadro 1.
Como hemos explicado (ver nuestros Barriles de Papel N.º 95, 70, 61 y 18 en
http://www.petroleum.com.ve/barrilesdepapel/), de estas reservas «conven-
cionales», PDVSA informa que para 2014 escasamente estaban desa-
rrolladas el 23,87 % de los crudos condensados, el 17,02 % de los li-
vianos, el 17,83 % de los medianos y el 24,2 % de los pesados; así las
reservas de gas natural solo están desarrolladas el 19,01 %. Más de-
talles en el cuadro 2.

de 20,5 oAPI. De ese volumen, el 54,32 % era menor a 21,9 oAPI (pesa-
do y extrapesado), el 24,54 % estaba entre 22,0 y 29,9 oAPI (mediano)
y el 21,14 % era de 30,0 o más oAPI (liviano y condensado). Se observa
cómo se había reducido la calidad de la producción con respecto a
1975. En materia de recursos humanos la nómina total llegó a
147.126 personas, de las cuales la estatal reconoce que 30.320 están
en actividades no petroleras.
A 40 años de la estatización de la industria petrolera nacional la si-
tuación no puede ser peor:
1. Para el momento de la estatización, la suma del ISLR, las regalías
y otros impuestos sumó 6.785,9 mmUS$, es decir, el 78,64 % del in-
greso total de las empresas (8.628,6 mmUS$); como referencia, en
16 años, para el período 1999-2014 este porcentaje es de apenas el
19,9 %.
2. Las «reservas probadas» oficiales de petróleo son 86,26 % de cru-
dos extrapesados (258.739 millones de barriles-mmb), de los cua-
les 255.958 mmb están en el Campo Faja del Orinoco, y el grueso
de las mismas no cumplen con las Normas sobre la materia, por
lo tanto son recursos. Un número más razonable de reservas pro-
badas para Venezuela sería 76.108 mmb, y para efectos prácticos
es mejor considerar solo 43.000 mmb.
3. En 2014, la producción oficial de petróleo cierra con un promedio
para el año de 2.779.000 b/d, es decir, a los niveles de 1995, pero la
OPEP la ubica a niveles de 1991 (2.381.000 b/d).
4. La producción cada vez es más pesada, con una gravedad prome-
dio de 20,5 oAPI. Para el momento de la estatización la gravedad
promedio era de 25,9 oAPI.
5. Los accidentes e incidentes en las refinerías y los derrames de pe-
tróleo, son tema de cada día.
6. El comisario de PDVSA informó que al cierre de 2014 la deuda fi-
nanciera de PDVSA era de 46.153 mmUS$, mientras al cierre de
Esas reservas no están desarrolladas porque no tienen los pozos
para producirlas, ni las facilidades de producción, plantas compre-
soras, ni los oleoductos y gasoductos necesarios. Para desarrollar
las reservas se requieren enormes inversiones y know-how, tecnolo-
gía, recursos humanos especializados y reglas claras.
El Plan 1998-2008, el último de la PDVSA democrática, apuntaba a
5.600.000 b/d, de los cuales por esfuerzo propio en las áreas tradi-
cionales serían 3.550.000 b/d, en las áreas de Convenios 750.000 b/d
y por esfuerzos de terceros en la Faja, junto con la CVP 1.300.000 b/d,
volúmenes totalmente razonables. Ello con unas reservas probadas
de 41.100 millones de barriles.
La caída libre en 15 años a que nos referimos arriba, ocurrió por
tres causas:
1. Primeramente, fue la inconveniente política de no más concesio-
nes, que canceló la actividad exploratoria con la consiguiente
pérdida de reservas, las cuales llegaron a límites tan bajos como
13.810 millones de barriles en 1973. Esto fue denunciado reitera-
damente por el visionario Ing. Arturo Hidalgo R. (ver nuestro Barriles
de Papel N.º 132)
2. Por el equivocado concepto arraigado en nuestra clase política de
que el petróleo había que conservarlo, que ellos entendieron
como no producirlo, cuando el concepto de la conservación es
puramente técnico, porque se refiere a la conservación de la
energía de los yacimientos
3. La equivocada política de cuotas dentro de la OPEP, que al recien-
temente fallecido Erwin Arrieta, exministro de Energía (1994-
1998) y presidente de la Conferencia de la OPEP (1995), se le atribu-
ye la frase según la cual la Organización era un Club de Pinochos.
En 2014, la producción oficial de petróleo cierra con un promedio

ubica a niveles de 1991 (2.381.000 b/d), con una gravedad promedio

En Exploración y Producción hay oportunidades principales, a corto
y mediano plazo, aun con la legislación actual:
a. Proceder a desarrollar las reservas probadas no desarrolladas de
petróleo y gas natural de las áreas tradicionales. Aquí están in-
cluidos los miles de pozos inactivos, clasificados por el Ministe-
rio de Petróleo y Minería como «Cerrados Capaces de Producir»,
que habrá que reemplazar por pozos con nuevas tecnologías de
producción.
b. Otorgar los contratos de servicio necesarios para toda la actividad
de servicios de infraestructura de las operaciones.
c. Otorgar los permisos necesarios para la recolección y venta del
gas producido.
d. Aumentar el factor de recobro de los yacimientos.
e. Otorgar los recursos (prospectos) existentes en tierra y costa afue-
ra para su exploración y eventual desarrollo.
f. Proceder a desarrollar las reservas no desarrolladas del Campo
Faja del Orinoco, permitiendo el libre uso de las 13 tecnologías
para explotarlas y las 5 tecnologías para comercializar la pro-
ducción.
En gas natural hay tres oportunidades principales:
a. Otorgar los permisos necesarios para la construcción y mante-
nimiento de la infraestructura de transporte (gasoductos) re-
querida para modernizar e incrementar la distribución de gas
metano.
b. Otorgar los permisos necesarios para la distribución y comercia-
lización de gas por tubería en las principales poblaciones.
c. Otorgar los permisos necesarios para el procesamiento, almace-
namiento y distribución del gas de bombona (GLP).
1998 era de apenas 7.102 mmUS$, y lo más negativo es que ese en-
deudamiento no es para incrementar las inversiones de la
estatal.
7. En materia de recursos humanos, la nomina total en 2014 llegó a
147.126 personas, de los cuales la estatal reconoce que 30.320 es-
tán en actividades no petroleras. Recordando que para el mo-
mento de la estatización el personal de la IPN totalizó apenas
23.733 empleados, con una producción de 2.346.202 b/d, produc-
ción similar a la que informa la OPEP para julio 2015.
7. Oportunidades de negociosEn toda la cadena de valor de la IPN (figura 1), las oportunidades de
negocios son muchas. Por la sencilla razón de que todas las activi-
dades, con excepción de la de Exploración y Producción (EyP), no es-
tán reservadas al Estado.

quema organizativo y de trabajo como el existente en el exitoso
National Petroleum Council-NPC de los EE.UU.
c. Dar todos los pasos necesarios para tener un Ministerio de Ener-
gía moderno, encargado de presentar las propuestas de políticas
públicas a la Asamblea, promover la investigación y desarrollo
en el sector, y representar al país en los asuntos internacionales
en materias de energía. Por Ley se prohibirá que los cargos de mi-
nistro de Energía y el de presidente de la estatal petrolera puedan
ser ocupados por la misma persona, rescatando así el rol del Mi-
nisterio de Energía como rector de la política energética y petro-
lera del país, y garante de su seguridad energética. Adicional-
mente, estarán adscritas al Ministerio de Energía las Oficinas,
Agencias y Comisiones para comunicarse con los ciudadanos y
garantizar sus derechos, en especial la libertad de empresa, el
respeto a las entidades privadas y la transparencia en la infor-
mación. La esencial característica de estos organismos será su
independencia del Ejecutivo, es decir, del gobierno de turno (aun
siendo dependencias estatales). Impulsará y apoyará la investi-
gación aplicada y el desarrollo en materia de energías renovables
y no renovables, así como promover con las universidades e insti-
tuciones privadas estudios en las áreas de petróleo, geología,
cuencas hidráulicas, energías renovables, combustibles, y otros
usos. También será el responsable de las publicaciones oficiales
contentivas de la información histórica nacional e internacional
sobre energía y su relación con la economía venezolana y mun-
dial (el actual Petróleo y Otros Datos Estadísticos-PODE, que tiene
50 años publicándose).
La relación entre los Entes propuestos se presenta esquemática-
mente en la figura 2:
En mercado interno la oportunidad obvia es otorgar los permisos
que se requieran para llenar el país de estaciones de servicio y
conveniencias.
En comercio y suministro la oportunidad es otorgar los permisos
que se requieran para que los particulares, nacionales y extranje-
ros, puedan comercializar crudos y productos, tanto a nivel nacio-
nal como internacional.
Así, en adiestramiento hay muchas oportunidades.
8. Qué hay que cambiara. Institucional En lo institucional es necesario acometer tres acciones prioritarias:
a. Proceder a crear el Ente Regulador de los Hidrocarburos, órgano
del Estado, independiente del gobierno de turno, autónomo y au-
tárquico, responsable de la administración, implantación y vigi-
lancia del cumplimiento de las políticas públicas correspondien-
tes, y regulación de las actividades; otorgar las licencias y
permisos para abrir todos los negocios «aguas arriba y abajo»,
elaborar la estadísticas, aplicar las multas, calcular y distribuir
las regalías, entre otras actividades.
b. Proceder a crear la Comisión Nacional de Energía, órgano del Es-
tado, independiente del gobierno de turno, autónomo y autár-
quico, ente responsable de la elaboración de propuestas de polí-
ticas públicas para el Sector Energético y de velar por el éxito del
propósito y objetivos de las mismas. Con el fin de garantizar un
balance en las grandes decisiones y orientación de la actividad
de la IPN, se debe incorporar a la Comisión Nacional de Energía
una representación significativa de los venezolanos, más allá de
representantes del Estado, tales como las empresas, entes finan-
cieros, academias, universidades, gremios y asociaciones socie-
dades civiles vinculadas al sector, entre otras, siguiendo un es-

c. Se puede comenzar con la política de permisos para instalar las
estaciones de servicio y conveniencia para el que los solicite, así
como con los permisos para que particulares participen plena-
mente en la distribución regional de gas metano y gas de bombo-
na, Promoviendo el desarrollo del sector gas, a través del sector
privado para la construcción y mantenimiento de los sistemas
de transporte (gasoductos) y redes de distribución de gas natural
en el mayor número de poblaciones.
d. Es necesario promover y desarrollar, respondiendo a las condi-
ciones del mercado: la Faja Petrolífera del Orinoco, las reservas
probadas no desarrolladas en áreas tradicionales, las áreas inac-
tivas, las áreas nuevas para exploración y futuro desarrollo, el
gas costa afuera, así como proyectos de gas natural licuado para
exportación.
e. Promover la creación de empresas para industrializar las co-
rrientes de refinación, así como nuevas petroquímicas.
f. Habrá que revisar, dentro de la ley, aquellos acuerdos internacio-
nales que sean lesivos al país.
g. Dar los pasos necesarios para comenzar el proceso de ajustes del
precio de todos los combustibles, y la revisión de la política de
subsidios.
h. Es necesario revisar la relación Estado-sociedad con respecto a la
renta que produce la actividad de los hidrocarburos, para que
esta vaya directamente a los ciudadanos. El excedente económi-
co que se origine en la actividad petrolera, que corresponde a la
nación, será destinado totalmente a la creación de un fondo, que
será el Fondo de ahorro, patrimonio e inversión de los venezola-
nos. Su rendimiento será entregado directamente a cada venezo-
lano a través de cuentas individuales. El Fondo será administra-
do en forma autónoma por una representación calificada de
venezolanos, y su administración estará en manos de entes fi-
nancieros nacionales e internacionales de la máxima solidez.

Paralelamente:
a. Se requerirá que desde el gobierno nacional se envíen al mundo
señales de estabilidad y legalidad que generen confianza. Se debe
satisfacer a cabalidad los compromisos contractuales con los so-
cios, para evitar demandas y hacer frente a los crecientes arbitra-
jes, situación que además de afectar el prestigio y la seriedad de
Venezuela, impacta la productividad de la industria petrolera.
b. Dar los pasos necesarios para impulsar la industria petrolera
nacional (IPN), en todas las fases del negocio: Exploración y Pro-
ducción (EyP), manufactura (refinación, mejoramiento y proce-
samiento), gas natural, comercio nacional e internacional, y ne-
gocios en el exterior; considerando que en la legislación actual
solo las actividades de EyP están reservadas al Estado.

Resalta que en los 15 años del régimen ha caído el volumen de cru-
dos procesados, así como el aporte de los crudos livianos (-205.000
b/d); y los otros insumos que se importan se han incrementado en
22.600 b/d. Es necesario proponer acciones concretas para garanti-
zar la Seguridad Energética (suministros confiables de combusti-
bles –gasolinas, diesel, fueloil, gas de bombona y gas metano por
tubería– para el sector eléctrico, transporte, y los sectores indus-
trial, comercial y residencial) mediante medidas tendentes a lograr
la gobernabilidad y la normalidad operativa de PDVSA y de las em-
presas mixtas. Es parte de la premisa del grave deterioro de nues-
tra principal industria y de la urgencia de mejorar su eficiencia y
eficacia, mediante un modelo diferente al anterior y al que existe
actualmente.
En el corto plazo, la estatal debe mantener su actividad que hoy
realiza como «esfuerzo propio», actividad que produjo 1.764.400 b/d
en 2014, es decir, el 60,9 % de la producción oficial; las empresas
mixtas produjeron 1.143.700 b/d, el 39,1 % de la producción oficial,
que totalizó 2.899.100 b/d.
En el cuadro 4 se presentan los consumos de productos refinados
entre 2005 y 2014, que nos dicen que hay que hacer todo lo necesa-
rio operacionalmente para producir en especial gasolinas, diesel y
fueloil (592 mil b/d) y asfalto (10,4 mil b/d), así como gas de bombo-
na-GLP (91 mil b/d) y gas metano por tubería (1.537 mmpc/d).
En Comunicados de COENER señalábamos:
a. Identificar el personal prioritario para garantizar la continuidad
de las operaciones.
b. Tomar control inmediato de los sistemas prioritarios de infor-
mación, tales como los operacionales, finanzas, comercio inter-
nacional y nómina
c. Establecer un Plan de Comunicaciones Internas permanente,
que baje la incertidumbre en el personal y genere un clima propi-
cio a la continuidad operativa
i. Se deberán revisar los Acuerdos y Convenios bilaterales y acon-
dicionarlos a los mejores intereses de la República.
j. Iniciar los procesos para modificar la legislación en materias de
hidrocarburos para facilitar la ejecución de los puntos antes
men cionados.
k. Promover el desarrollo de las ciencias y tecnologías, creando opor-
tunidades para la investigación y desarrollo en todas las fases de
los sistemas de oferta y demanda de los sistemas energéticos.
b. Relaciones entre propietarios del recurso y particularesRespecto a las relaciones entre los propietarios del recurso y los
particulares, me permito recordar que mi propuesta es que PDVSA
deje de ser una operadora y se convierta en una excelente adminis-
tradora de los Contratos de Producción Compartida (Production Sha-
rings), en nombre de los propietarios del recurso, todos los ciudada-
nos. Sobre lo anterior se tienen los extraordinarios ejemplos de las
Asociaciones de la Faja, donde PDVSA tenía menos del 50 % de parti-
cipación y todo marchaba exitosamente. Mientras se cambia la Ley
Orgánica de Hidrocarburos, con voluntad política, se puede usar la
figura de las empresas mixtas para tal fin, con los particulares te-
niendo por lo menos el 49 % de participación en los negocios.
Para las actuales actividades que realiza PDVSA como de esfuerzo
propio se pueden firmar Contratos de Servicio.
9. Propuestas a corto plazo (The day after)PDVSA, con mala intención, no presenta en su Informe de Gestión
2014 los volúmenes de crudo procesado por las refinerías venezola-
nas, solo la suma total de las refinerías nacionales e internaciona-
les; tampoco muestra la carga de las refinerías por tipo de crudos,
por ello para el análisis acudimos a los Informes PODE 1998 y 2012
del Ministerio de Petróleo y Minería, que se muestra en el cuadro 3.

g. Contactar a la comunidad financiera nacional e internacional
para garantizar el cumplimiento de los compromisos de la em-
presa y asegurar que se mantengan los flujos de créditos para
una PDVSA debilitada financieramente.
Para llevar adelante lo anterior, se requiere, como se señaló ante-
riormente, lograr la gobernabilidad y la normalidad operativa de
PDVSA y de las empresas mixtas:
En términos de gobernabilidad, se hace necesario un pacto entre
los diferentes actores políticos que contemple la no interferencia
del Ejecutivo en las actividades operacionales, ni en la designación
de los ejecutivos, salvo en el nombramiento de la Junta Directiva de
la Casa Matriz. Igualmente, será imprescindible un acuerdo de paz
laboral con la dirigencia sindical. Así mismo, habrá que asegurar a
los socios, contratistas y proveedores la continuidad de las relacio-
nes de negocio debidamente contratadas y comprometidas.
Con respecto a la normalidad operativa, el objetivo inmediato es
garantizar que la producción de petróleo y gas natural, y la refina-
ción no sigan decayendo, que disminuya el número de accidentes y
que la comercialización y las contrataciones se realicen con trans-
parencia. Para ello es imprescindible el respeto al personal que ac-
tualmente labora en esas actividades. En esta etapa es de vital im-
portancia una excelente relación con los dirigentes sindicales. Así
como el cumplimiento de las normas de seguridad en el trabajo, hi-
giene ocupacional y respeto al medio ambiente.
Para regresar a la normalidad operativa completa, será necesario
resarcir a las personas naturales y jurídicas que han sido afectadas,
negociando las formas de pago de las compensaciones requeridas.
Lo prioritario será el reconocimiento oficial de todas las deudas y
compromisos con el personal ilegalmente expulsado en 2002 y 2003.
La designación de una nueva Directiva debe inspirar confianza tan-
to a los trabajadores de la IPN, como ante la sociedad venezolana.
Para ello los nuevos directores deben ser reconocidos por su honra-
d. Realizar evaluaciones técnico-operacionales y de procesos ad-
ministrativos en las principales áreas del negocio y en los pro-
gramas de responsabilidad social.
e. Será necesario realizar una auditoría técnico-financiera, de re-
servas, del estado de los yacimientos e instalaciones, así como
evaluar rigurosamente la viabilidad de aumentar la producción.
f. Asegurar instalaciones de alta criticidad tales como refinerías y
llenaderos de combustible, gasoductos, plantas compresoras de
gas y centros de despacho de gas.

Resumiendo, la República de Venezuela deberá:
a. Lograr la gobernabilidad de PDVSA. Se hace necesario un pacto
entre los diferentes actores políticos que contemple la no interfe-
rencia del Ejecutivo en las actividades operacionales, ni en la de-
signación del tren directivo y gerencial, salvo en el nombramien-
to de la Junta Directiva de la Casa Matriz. Igualmente, será
imprescindible un acuerdo de paz laboral con la dirigencia sindi-
cal. En las filiales petroleras, 40.124 empleados tienen 45 años o
más, y de estos 13.597 ya están en edad de jubilación. El resto de
los empleados, en edad laboral, en la medida en que haya más
empresas privadas, que pagarían en dólares a sus empleados y
con Actas Convenio laborales mejores que la Convención Colec-
tiva de PDVSA, irían renunciando a PDVSA y pasando a las mis-
mas, y esto es válido para las dos nóminas. Hay que tener presen-
te que con reglas claras, respeto a la propiedad y Estado de
derecho, las empresas relacionadas con el negocio de hidrocar-
buros que se establecerán en el país deben contarse por miles.
b. Garantizar la seguridad energética del país. La «Seguridad Ener-
gética» implica que deben producirse en el corto plazo el petróleo
y el gas natural para producir por lo menos 573.000 b/d de pro-
ductos refinados (en especial gasolinas y diesel, incluyendo
10.000 b/d de asfalto), 90.000 b/d de gas licuado de petróleo (gas
de bombona) y 3.000 mmpc de gas metano. PDVSA y los particula-
res tendrá cada uno una alícuota de su producción para cargar
las refinerías y atender el mercado interno
c. Dictar todas las medidas necesarias para impulsar el desarrollo
acelerado de la producción de gas natural para atender al máxi-
mo el parque termoeléctrico
d. Garantizar la continuidad operacional, permitiendo a las em-
presas mixtas producir al máximo (dejándolos trabajar), y pro-
moviendo la política financiera aplicada al Campo Boscán; per-
mitiendo que los particulares comercialicen el crudo producido;
dez, ecuanimidad, conocimiento del negocio y capacidad gerencial.
A esta directiva le corresponderá reorganizar a la empresa para
mejorar la eficiencia y eficacia de la misma.
Finalmente esta el tema del manejo de los recursos humanos ac-
tualmente trabajando en la estatal. En el 2002 PDVSA contaba con
una nómina de 39.354 trabajadores propios y 28.329 contratados y
estaba en reducción. En la actualidad, según cifras del Informe
2014 de PDVSA, laboran 147.126 trabajadores, de los cuales 30.320 no
están en actividades del sector; además, hay 25.698 contratistas.
Consideramos que a los trabajadores reclutados con buenas cre-
denciales después del 2002, solo se les exigiría que no participen en
actividades políticas partidistas dentro de la empresa. Los trabaja-
dores que no estén calificados deberán someterse a un período in-
tensivo de entrenamiento.
A los trabajadores despedidos ilegalmente en el 2002-2003 deberá
reconocérseles todos los derechos laborales atropellados y su regre-
so a la estatal dependerá de las necesidades de la misma, y de que
estos estén en capacidad profesional de regresar. Los aptos para la
jubilación deberán ser jubilados.
PDVSA tiene actualmente 118 unidades productivas, 28 empresas y
6 grupos industriales no relacionados con el negocio de los hidro-
carburos, organizaciones que no tienen nada que ver con la misión
de una verdadera empresa petrolera. Esas organizaciones y su per-
sonal deben ser transferidos progresivamente a los organismos ofi-
ciales relacionados. Los empleados de las filiales no petroleras pue-
den ser liquidados y asignados a las organizaciones del Estado y/o
gobierno relacionadas con su trabajo. En las filiales no petroleras
hay 2.607 empleados en edad de jubilación, por lo que la situación
crítica para moverlos se reduce. En cualquier caso, esta será una de
las primeras auditorías que tendrán que realizarse para buscar so-
luciones a esta situación, asesorada con una organización de Desa-
rrollo Organizacional que debe crearse a la brevedad durante la
transición.

y puedan repatriar sus capitales (como en Cuba y otros países
petroleros)
e. Establecer las reglas claras para atraer los capitales nacionales e
internacionales, know-how y tecnologías que se necesitaran para
desarrollar plenamente los recursos de hidrocarburos
f. Proceder a desarrollar las reservas probadas no desarrolladas de
petróleo y gas natural, aumentar el factor de recobro de los yaci-
mientos, otorgar los recursos (prospectos) existentes en tierra y
costa afuera
g. Proceder a desarrollar las reservas no desarrolladas del Campo
Faja del Orinoco, permitiendo el libre uso de las 17 tecnologías
para explotarlas y las 6 tecnologías para comercializarla
10. Propuestas a mediano plazoCon respecto a la producción, hemos insistido en que los volúme-
nes a producirse lo dictarán en primer lugar lo requerido para la
«seguridad energética» (el mercado interno) y lo que digan los mer-
cados internacionales en materia de exportación. Cada licenciata-
rio utilizará y aprovechará la que más le convenga, en la medida en
que consiga sus mercados. En lo anterior hay que destacar que ni el
Ente Regulador, y mucho menos el Gobierno de turno deben inmis-
cuirse en estas decisiones de los particulares (la OPEP, compromisos
geopolíticos dixit). Si el gobierno desea negociar petróleo por alguna
razón política, lo puede hacer con una porción la figura de las rega-
lías que le pueda corresponder como se hizo en el pasado (recor-
dando que el grueso de las mismas irá al Fondo de los ciudadanos).
En el período 1999-2014, la producción de los crudos más comercia-
les ha caído estrepitosamente: los livianos han disminuido en
817.000 b/d y los medianos en 518.000 b/d, lo que explica la caída en
estos crudos procesados por las refinerías nacionales, y la necesi-
dad de comprar más insumos del exterior (ver cuadro 3).
Factores a tomar en cuenta para elevar la producción:
1. La primera opción es desarrollando las reservas probadas no
desarrolladas.
2. Un segundo elemento a considerar para hacer estimados de pro-
ducción futura de petróleo es la cifra de «factor de recobro», es
decir, la cantidad de petróleo que se puede recuperar del petróleo
total en los yacimientos, con las tecnologías, recursos humanos
y precios existentes. En el caso de Venezuela, PDVSA ha informa-
do que el factor de recobro de los crudos condensados/livianos/
medianos está en 30,23 %; el de los crudos pesados y extrapesa-
dos, en 11,05 %, para un promedio nacional de 15,45 %. Este pro-
medio nacional está muy por debajo del promedio estimado in-
ternacional (40 %), lo que dice que hay oportunidades de elevar la
producción incrementando el factor de recobro de los yacimien-
tos, tanto en las áreas activas como en las inactivas.
3. El otro factor a considerar para elevar la producción es el núme-
ro de pozos inactivos existentes en las áreas operadas hoy por
PDVSA, de los cuales un porcentaje se podría reactivar, y lo más
importante es que en sus áreas de influencia hay reservas proba-
das que solo debe procederse a explotarlas con pozos nuevos y
nuevas tecnologías de producción. La cifra oficial del Ministerio
de Energía, para el 31-12-2012, de pozos capaces de producir es de
36.690, de los cuales están en producción 17.678 (48,2 %), y están
cerrados pero son «capaces de producir» 18.160 (49,5 %, hay un
2,3 % de pozos perforados que estaban suspendidos). Para el 2015
el número debe ser mayor. Hemos aclarado que esa figura de «po-
zos cerrados capaces de producir» no es que se van a abrir y pun-
to. Algunos técnicos consideramos que miles de esos pozos es-
tán perdidos (no pueden ser recuperados), por el tiempo que
tienen inactivos, y habrá que reemplazarlos completamente con
pozos nuevos. Muchos de estos pozos están en campos total-
mente inactivos, que deberían darse en Contratos de Servicio y
luego en Licencias, pero la mayoría está en áreas en producción

de PDVSA, lo que dificulta su asignación individual, pero pueden
ser tratados por empresas mixtas que también manejarían los
pozos activos vecinos (el caso de los campos Boscán y Dación son
emblemáticos en este modelo). En la 1ra. Ronda se «reactivaron»
177 de esos pozos, en la 2da. Ronda 1.627, y en la 3ra. Ronda 1.635
pozos, para un total de 3.439 pozos. Muchos fueron reemplaza-
dos por pozos nuevos.
Nuestra propuesta es que PDVSA vaya asignando todas sus áreas
bajo la figura de Contratos de Servicio (Convenios Operativos),
mientras se cambia la Ley de Hidrocarburos para pasar todo a
Contratos de Producción Compartida (PSA).
4. Explorando y desarrollando los recursos por descubrir, tanto en
tierra como costa afuera. Este fue el caso de las 8 áreas que se
otorgaron bajo la figura de Exploración a Riesgo y Ganancias
Compartidas, donde PDVSA podía llegar a tener hasta 35 % de par-
ticipación, bajo la figura de Ganancias compartidas o Profit Sha-
ring, es decir, la estatal corría con su porcentaje en los CAPEX y
OPEX. De allí nuestra propuesta de los Production Sharing, donde el
dueño del recurso no corre con los gastos de CAPEX y OPEX, y solo
comparte con el socio particular un porcentaje de la producción.
Estas figuras de Contratos las hemos explicado muy bien en nues-
tros Barriles de Papel N.º 86 y 87.
De las 8 áreas licitadas 3 resultaron exitosas (La Ceiba, Golfo de Pa-
ria Este y Oeste), es decir, un éxito exploratorio de 37,5 %, muy bueno
para la actividad. La oportunidad es clara porque hay más de 650
prospectos para ofrecer por el Ente Regulador, y ya aparecerán los
particulares interesados en buscar para sus mercados y refinerías
crudos livianos en esas áreas tradicionales.
Para satisfacer el mercado interno, a cada productor se le podría fi-
jar una cuota en función de su producción, y este tendría que entre-
garlo a la refinería de su conveniencia, y de común acuerdo con el
Ente Regulador.
La administración actual ha facilitado el trabajo para la transición
con la creación de la nueva CVP, la cual fue diseñada para adminis-
trar los negocios aguas arriba de la estatal, no operarlos.
Desde el primer día, el Ministerio de Petróleo y Minería, conjunta-
mente con miembros de la directiva de PDVSA nombrados para tal
efecto, deben comenzar a dar los pasos necesarios para llevar a la
IPN a una situación de óptimo desarrollo y actuación.
Como dijimos anteriormente, en el corto plazo la estatal debe man-
tener su actividad que hoy realiza como «esfuerzo propio», así las
Empresas Mixtas, pero en el período de transición las Empresas
Mixtas deben aumentar su producción al máximo (PDVSA debe de-
jarlas trabajar) y la estatal ir reduciendo su participación en la pro-
ducción. PDVSA no debe crecer más, e ir pasando sus actividades de
«esfuerzo propio» a Contratos de Servicios (los anteriores Conve-
nios Operativos); así, todas la áreas inactivas y las áreas nuevas, de-
ben ser pasadas al Ente Regulador para que las licite primero como
Empresas Mixtas (51-49 % que lo permite la Ley de Hidrocarburos),
que al reformarse la Ley se convertirían en Contratos de Produc-
ción Compartida (Production Sharing), contratos en los cuales el due-
ño del recurso, los ciudadanos, no tienen que invertir (CAPEX) ni co-
rrer con los gastos (OPEX) de exploración y explotación. PDVSA debe
convertirse eventualmente en solo la administradora del recurso
de los ciudadanos, y dejar de ser una operadora, para alejar el fan-
tasma de «la tentación totalitaria» que aleja a los inversionistas na-
cionales e internacionales. Esta tentación es la que estamos viendo
en Colombia con Ecopetrol, en Brasil con Petrobras y en Perú con
Petroperú, donde las estatales, después del éxito de las empresas
particulares, dicen que ellos lo pueden hacer, y no les están reno-
vando las licencias, o como en el caso de Brasil, que se cambio la
Ley para que la estatal sea la única operadora en las áreas nuevas, y
los socios, «bien, gracias».
La figura de Producción Compartida (Production Sharing) se ha esta-
do utilizando exitosamente en muchos países petroleros y, más re-

cientemente, en la Reforma Energética de México, y para la explota-
ción del «Pre-Salt» de Brasil.
Para el desarrollo de los recursos de gas natural, la situación es más
fácil, porque esta actividad no está reservada al Estado, por lo que el
Ente Regulador debe comenzar, una vez constituido, a ofrecer todas
las rondas que sean necesarias para la explotación del gas natural
costa afuera. La propuesta de la nueva IPN se muestra en la figura 3

11. ConclusionesUna propuesta para rescatar la industria petrolera nacional pasa
por garantizar la «Seguridad Energética», y esta va a depender de
comprometerse a manejar, con el concurso de los mejores, la gober-
nabilidad de la estatal PDVSA y la continuidad operacional. Habrá
medidas críticas que tomar en el muy corto plazo (the day after), en
especial dejar trabajar a los socios actuales de las empresas mixtas,
que son los que pueden mantener y elevar la producción en el me-
nor tiempo; y desarrollar políticas en materia de energía para ase-
gurar el mediano plazo, o período de transición.
Venezuela debe prepararse para aprovechar «la ventana» que le
queda al petróleo, dentro de su protagonismo en la matriz energéti-
ca mundial, así como avanzar en medidas concretas para desarro-
llar los recursos de gas natural, combustible que tiene mucho más
futuro que el petróleo. Todo lo anterior tiene que contar con la vo-
luntad de los grupos de interés, en especial los políticos. Y estos, en-
tender que los hidrocarburos no son estratégicos, ni sus industrias
son básicas; así mismo, que no tienen nada que ver con la soberanía
ni con la independencia del país.
Venezuela tiene los recursos de petróleo y gas natural para llevar
adelante el rescate de la industria petrolera nacional (IPN), que es
mucho más que PDVSA. Este rescate necesitará inmensas inversio-
nes de nacionales y extranjeros, así como la participación de las me-
jores empresas internacionales, que traerían su know-how y tecnolo-
gías. Para garantizar lo anterior, el país debe dar claras muestras de
que respetará los compromisos que se adquieran, el respeto a la
propiedad privada y el Estado de derecho, es decir, las reglas deben
estar muy claras. En lo económico, desmontar el control de cambio,
y permitir la libre expatriación de los capitales; en lo laboral, des-
montar las decenas de leyes que hoy asfixian la actividad privada.
La estatal PDVSA debe dejar de ser operadora, para eliminar la «ten-
tación totalitaria», y convertirse en una excelente administradora
del recurso de todos los venezolanos, para que a nombre de estos
firme y administre los contratos que sean necesarios con el sector
privado nacional e internacional, en especial los Contratos de Ser-
vicios, y los Contratos de Producción Compartida, entre otros.

I. En el muy corto plazo:•La designación de una nueva Directiva de la estatal PDVSA debe
inspirar confianza tanto a los trabajadores de la IPN, como a la so-
ciedad venezolana.
•Desde el primer día, el Ministerio de Petróleo y Minería, conjun-
tamente con los nuevos miembros de la directiva de PDVSA, de-
ben comenzar a dar los pasos necesarios para llevar a la IPN a
una situación de óptimo desarrollo y actuación.
•Se hace necesario un pacto entre los diferentes actores políticos,
que contemple la no interferencia del Ejecutivo en las activida-
des operacionales, ni en la designación del tren directivo y geren-
cial de la estatal.
•Será imprescindible un acuerdo de paz laboral con la dirigencia
sindical.
• Identificar el personal prioritario y las posiciones para garanti-
zar la continuidad de las operaciones.
•Tomar control inmediato de los sistemas prioritarios de infor-
mación, tales como los operacionales, finanzas, comercio inter-
nacional y nómina.
•Establecer un Plan de Comunicaciones Internas permanente,
que baje la incertidumbre en el personal y genere un clima propi-
cio a la continuidad operativa.
•Realizar auditorías técnico-operacionales y de procesos admi-
nistrativos en las principales áreas del negocio y en los progra-
mas de responsabilidad social.
•Será necesario realizar una auditoría técnico-financiera, de re-
servas, del estado de los yacimientos e instalaciones, así como
evaluar rigurosamente la viabilidad de aumentar la producción.
•Asegurar instalaciones de alta criticidad, tales como refinerías y
llenaderos de combustible, gasoductos, plantas compresoras de
gas y centros de despacho de gas.
•Comenzar a enviar al mundo señales de estabilidad y legalidad
que generen confianza.
•Contactar a la comunidad financiera nacional e internacional
para garantizar el cumplimiento de los compromisos de la em-
presa y asegurar que se mantengan los flujos de créditos para
una PDVSA debilitada financieramente.
•Respecto a las relaciones entre los propietarios del recurso y los
particulares.
II. En el mediano plazoa. En lo institucional:
•Crear el Ente Regulador de los Hidrocarburos.
•Crear la Comisión Nacional de Energía.
•Tener un Ministerio de Energía moderno.
•Dar los pasos necesarios para impulsar la industria petrolera na-
cional (IPN), en todas las fases del negocio.
•Establecer las reglas claras para atraer los capitales nacionales e
internacionales, know-how y tecnologías que se necesitarán para
desarrollar plenamente los recursos de hidrocarburos.
•Tener presente que con reglas claras, respeto a la propiedad y Es-
tado de derecho, las empresas relacionadas con el negocio de hi-
drocarburos que se establecerán en el país deben contarse por
miles.
•PDVSA debe dejar de ser una operadora y convertirla en una exce-
lente administradora de los futuros Contratos de Producción
Compartida (Production Sharings), y para que las actuales activi-
dades que realiza PDVSA como de esfuerzo propio se transformen
en Contratos de Servicio.
•Revisar todos los acuerdos geopolíticos internacionales y acon-
dicionarlos a los mejores intereses de la República.

•Dictar todas las medidas necesarias para impulsar el desarrollo
acelerado de la producción de gas natural, para atender al máxi-
mo el parque termoeléctrico.
•Promover la creación de empresas para industrializar las co-
rrientes de refinación, así como nuevas petroquímicas.
•Comenzar con la política de permisos para instalar las estacio-
nes de servicio y conveniencia para el que los solicite, así como
con los permisos para la distribución regional de gas metano y
gas de bombona.
c. En materia de recursos humanos:
•Resolver la situación de los recursos humanos actualmente tra-
bajando en la estatal.
•A los trabajadores despedidos ilegalmente en el 2002-2003 debe-
rá reconocérseles todos los derechos laborales atropellados, y su
regreso a la estatal dependerá de las necesidades de la misma, y
de que estos estén en capacidad profesional de regresar. Los ap-
tos para la jubilación deberán ser jubilados.
•Resarcir a las personas naturales y jurídicas que han sido afecta-
das, negociando las formas de pago y de las compensaciones re-
queridas.
•A los trabajadores reclutados con buenas credenciales después
del 2002, solo se les exigirá que no participen en actividades polí-
ticas partidistas dentro de la empresa.
•Los trabajadores que no estén calificados deberán someterse a
un período intensivo de entrenamiento.
•Las 118 unidades productivas, 28 empresas y 6 grupos industria-
les no relacionadas con el negocio de los hidrocarburos, organi-
zaciones que no tienen nada que ver con la misión de una verda-
dera empresa petrolera, y su personal deben ser transferidos
progresivamente a los organismos oficiales relacionados.
•Comenzar el proceso de ajustes del precio de todos los combusti-
bles, y la revisión de la política de subsidios.
•Revisar la relación Estado-sociedad con respecto a la renta que
produce la actividad de los hidrocarburos, para que esta vaya di-
rectamente a los ciudadanos.
• Iniciar los procesos para modificar la legislación en materias de
hidrocarburos para facilitar la ejecución de los puntos antes
mencionados.
•Promover el desarrollo de las ciencias y tecnologías, creando opor-
tunidades para la investigación y desarrollo en todas las fases de
los sistemas de oferta y demanda de los sistemas energéticos.
b. En lo operacional:
•Lograr la gobernabilidad y la normalidad operativa de PDVSA y de
las empresas mixtas.
•En el corto plazo la estatal debe mantener su actividad que hoy
realiza como «esfuerzo propio», y las empresas mixtas aumentar
su producción.
•Garantizar la continuidad operacional, permitiendo a las empre-
sas Mixtas producir al máximo (dejándolos trabajar), y promo-
viendo la política financiera aplicada al Campo Boscán.
•Permitir que los particulares comercialicen el crudo producido,
y puedan repatriar sus capitales.
•Promover y desarrollar, respondiendo a las condiciones del mer-
cado: la Faja Petrolífera del Orinoco, las reservas probadas no de-
sarrolladas, las áreas inactivas, y las áreas nuevas para explora-
ción y futuro desarrollo.
•PDVSA debe asignar todas sus áreas bajo la figura de Contratos de
Servicio (Convenios Operativos) mientras se cambia la Ley de Hi-
drocarburos, para pasar todo a Contratos de Producción Com-
partida (PSA).

ForewordThose of us who have had to bustle in Venezuela’s reality regarding
oil have learned to differentiate between the politically biased dis-
torted vision –the «very red» PDVSA which was sold to us by those who
directed our oil home office- and serious and professional proposals
offered by the persons with real knowledge of our industry.
PDVSA was a veritable breeding ground for brilliant professionals
who, based on their ongoing merits, were offered the chance to train
as comprehensively as possible in the areas of their professional ca-
reers. As they ascended positions of higher hierarchy, the nation not
only offered them opportunities: they also benefitted from the
knowledge and expertise of the men with the know-how and capabil-
ities needed to adopt decisions of enormous transcendence.
«Meritocracy» was the name given to that policy, that contributed to
training so many of the top-notch professionals who transformed
PDVSA into what it became: one of the most important oil transna-
tionals in the world.
Diego González is one of these men Venezuela has a debt to. He began
as a professional oil technician, and he later graduated as an oil engi-
neer from Universidad del Zulia, Tulsa University in Oklahoma and
afterwards from IESA. He therefore has an impeccable academic
training.
Throughout his career, he worked in high-ranking managerial posi-
tions in diverse areas within the industry. He has acted as a consul-
tant for the Inter-American Development Bank and the Instituto
Latinoamericano de Investigaciones Sociales (Ildis). He has been a
member of the academic council at Cedice Libertad and as a coordina-

González concludes that «the brunt of oil reserves presented to the
nation and the world by PDVSA corresponding to those found at the
Orinoco Oil Belt do not meet the standards of the Department of Pe-
troleum and Mining of Venezuela nor with international regulations,
and therefore cannot be deemed to be proven reserves».
This does not mean to say that Venezuela does not have abundant
proven oil reserves. Nobody questions that these exceed the com-
bined proven reserves of Mexico, Brazil, Colombia, Argentina, Ecua-
dor and Peru. We have more than sufficient reserves to increase our
nation s production to at least 4 million barrels per day for the next 30
years.
Among the multiple proposals in this article, I am attracted to the
one entitled the «window of opportunities» which is open for Venezu-
ela to take advantage of the oil wealth bestowed by nature on this
country:
«The world s main institutional forecasts (IEA, EIA, OPEC, WEC, among
others), as well as corporate forecasts (ExxonMobil, Shell, BP), and
more recently, the Russian Science Academy, estimates an oil share
in the worldwide energy matrix of between 23 % and 31.8 % for 2035-
2040, the OPEC estimate being 24.3 % for 2040».
Venezuela must take advantage of the remaining time frame left, be-
cause undoubtedly a large part of our reserves shall remain forever
in the subsoil. Oil as an energy asset shall slowly lose its position to
other, less contaminating energy sources. Insofar as they become
more energy-efficient, other energy sources shall displace its use.
Natural gas has more future than oil, since it is a far less contaminat-
ing fossil fuel. It is «called to replace coal in the generation of electrici-
ty and many oil by-products for transportation purposes. As we have
seen, Venezuela has immense resources of this hydrocarbon».
We must therefore act swiftly, decisively and smartly. In the follow-
ing pages, Diego González presents his recommendations to embark
tor of its energy studies center, He is the former chairman of COENER,
and has published extensively. With all these accrued merits he was
made a correspondent member of the National Academy of Engi-
neering and Habitat.
This is the solid intellectual, professional and academic background
that backs this paper by Diego González. In it, he presents a Proposal
to Re-launch the National Oil Industry, edited by Cedice Libertad.
It is obvious that, once the current economic and political model that
has caused so much harm to Venezuela is left behind, the country
will have to engage in major efforts to recuperate its principal indus-
try, which has degraded and has fallen into an unacceptable morass
of incompetence, dogmatism and corruption. Countless opportuni-
ties have been lost. The nation s oil production is floundering, and
major markets have been lost and have been replaced by others in
which we are not competitive, or in which the aim has been to obtain
a political dividend in accordance to the dogmatic vision of those who
presently govern, instead of an economic dividend which could have
contributed to set the nation on a path of development and the over-
coming of our social problems.
The merit of this proposal by Diego González is that it states the truth
based on real numbers and technical reasoning.
In it, Diego González proceeds to dismantle the myth that Venezuela
has the largest oil reserves in the world. For the time being, the prov-
en reserves in the Orinoco Oil Belt seem to be grossly over-estimated.
The «government does not tire of saying that we are the country with
the largest oil reserves in the world, especially in the Orinoco Oil
Belt»... «It is important to recall that the stated number of proven oil
reserves in the Orinoco Oil Belt derived from a presidential whim in
2007, when he decided to multiply an original-oil-in-situ value by an
exaggerated recovery factor (RF) of 19 %». Up until that time, the re-
covery factor that had been used was 4.1 %.

changes which must be carried out and he presents plans for «the
very short term (The day after)», «the short term» and «the mid-term».
The Proposal to Re-launch the National Oil Industry presented by
Cedice Libertad and drafted by Diego González is an extraordinary
contribution and a must read for analysis, not only for anyone inter-
ested in learning about what has happened in the Venezuelan oil in-
dustry, but also for those who will shoulder the responsibility and
will in the future be in charge of its reconstruction.

1. Summary Spurred on by the need to rescue the national oil industry (NOI) in
the coordination of a group of professionals linked directly and in-
directly to it, constituted at the Centro de Estudios de Energía de
Venezuela (in English, Center for Studies on Energy in Venezuela
-CEEV for its acronyms in Spanish) at Cedice-Libertad, I have draft-
ed this document for the purposes of promoting discussions and ac-
tions to attain an oil industry in Venezuela that is maximized
organizationally, technologically and financially through public and
private investments for the benefit of its legitimate owners: the Ven-
ezuelans, contributing towards generating a socio-economic dy-
namics that would enable us to take the path towards becoming a
developed nation.
The initial objective of this document is to propose actions to guaran-
tee energy security, through measures tending towards attaining
governability and operational normalcy at PDVSA and the rest of the
companies comprising the NOI. Part of the premise is the serious de-
terioration of our principal industry and the pressing need to en-
hance its efficiency and efficacy by means of a different model than
that which has existed until 1998 and different from the existing one.
On the other hand, the passing of time has evidenced that basing the
nation’s development solely on oil-based revenues is absurd and in-
flationary; crude oil price fluctuations have repeatedly caused crises
in the nation’s budget, tax base, and monetary issues. When oil prices
drop, violent adjustments are imposed which the governments have
not been able to handle, which deteriorate the welfare of the popula-
tion, situations which are attempted to be resolved by increasing the
domestic and foreign debt (thus engaging the country in commit-
ments with powers such as China and Russia), diminishing the na-

tion’s reserves at the Central Bank of Venezuela (BCV for its acronyms
in Spanish), and ultimately selling off assets of State-owned compa-
ny PDVSA.
Another aspect to bear in mind is that although oil byproducts con-
tinue to be the main source of energy, we must visualize that in a
term of 30 to 40 years it shall lose importance compared to natural
gas and alternative sources. Therein lies the need for developing it ef-
ficiently and properly investing the revenues obtained from it in pro
of the wellbeing of the current and future generations. It is worth-
while highlighting that it is probable that we shall find ourselves in
2016 in a complicated economic scenario if the Government contin-
ues to use oil resources for populist electoral purposes, leaving the
nation with fewer reserves, thereby increasing cash flow problems at
State-owned PDVSA and the treasury.
Given the precarious situation of the reserves at the BCV and a higher
amount to service the public debt in 2016 and following years, it is
very possible that the next government sees its macroeconomic ma-
neuvering capacity diminished. We are estimating that crude oil ex-
ports should reach no less than 71 billion dollars in order to guarantee
said payments, PDVSA’s most indispensable imports and commit-
ments, a lofty figure that seems unattainable with the situation of
the prices for what is left of 2015 and 2016; not to mention having to
substantially increase production so as to compensate for the price
hikes.
We consider that any action geared towards broaching the future of
the national oil industry must be amply discussed with the political
and national sectors, within a framework of an honest, transparent
and competitive management that respects the workers and pro-
cures making of the oil business a generator of the maximum level of
wellbeing for the citizens and the nation. Reminding the groups of in-
terest that hydrocarbons, and especially petroleum, have nothing of
strategic, nor is it a basic industry, and least of all is it synonymous of
sovereignty, independence and social development, all of which were
paradigms created by our political classes, and which have taken
roots in the national imagination.
The proposals to rescue and re-launch the national oil industry (NOI)
are based on the proven oil and natural gas resources and reserves
the nation counts on, bearing in mind that one thing is to have re-
sources and even reserves and another is to have the real capacity to
produce and trade them, which is the tragedy of the majority of
the OPEC nations, and especially Venezuela, whose government nev-
er ceases to state that we are the nation with the largest oil reserves
in the world, located mostly in the Orinoco Oil Belt, but which has not
managed to increase production. It is important to recall that the fig-
ure for the proven oil reserves in the Orinoco Oil Belt was derived
from a presidential whim in 2007. For the foregoing reasons, the
brunt of the oil reserves presented by PDVSA to the nation and the
whole world correspond to those found in the Orinoco Oil Belt but
which do not comply with the standards for the dispatch of petro-
leum and mining products in Venezuela or international regulations
and therefore cannot be considered proven oil reserves.
Nowadays, if petroleum is not refined, it is worthless. The world’s
principal forecasters, including institutions (IEA, EIA, OPEC, WEC,
among others), financial companies, as well as petroleum companies
(ExxonMobil, Shell, BP), and more recently the Russian Science Acad-
emy, estimate Venezuela’s petroleum share in the world energy ma-
trix of 23 % to 31.8 % for the 2035-2040 period, the OPEC estimate being
24.3 % for 2040. This is what we have taken to calling «the window of
opportunity for Venezuelan petroleum». Natural gas has more fu-
ture than petroleum, because it is the least contaminating fossil fuel
and there are many more resources. Venezuela has huge numbers of
this hydrocarbon.
With respect to the Venezuelan reserves, for any production calcu-
lations, the reserves in the traditional areas («conventional crude
oils») totaling 76 billion barrels would be more than sufficient. The
previous number includes the 4 former associations at the Faja (the

name in Spanish for the Orinoco Oil Belt). However, considering that
there are several colleagues who doubt these developed and non-de-
veloped reserves as of 1998, and being conservative, I suggest that the
figure of 43 billion barrels be used for the calculations, which for all
intents and purposes are more than the aggregate proven oil re-
serves of Mexico, Brazil, Colombia, Argentina, Ecuador and Peru.
This volume of proven oil reserves could result in a production of
close to 4,000,000 b/d over the next 30 years.
The value chain of the NOI begins with exploration and production
activities (E&P). In general, the NOI-related discussions and proposals
usually turn around the «upstream activities», meaning to say E&P.
After E&P activities come the manufacturing of produced hydrocar-
bons (refining, enhancement of Orinoco Oil Belt crude oils, and natu-
ral gas processing); Natural gas byproducts, followed by Transporta-
tion and storage; domestic and foreign trade; those inherent to the
domestic market, and continuing on with research, development
and training, which are no less important, to finally conclude with
businesses abroad. By law all these activities, with the exception of
E&P, are not reserved to the State, meaning to say that they can be un-
dertaken by the private sector «together with State-owned compa-
nies – or not-», as our hydrocarbons legislation states.
The foregoing means that with the proper political will an entire ar-
ray of opportunities opens up for the full development of the NOI with
the participation of the national and international private sector.
There are numerous business opportunities in the entire value chain
of the NOI, for the simple reason that all the activities, with the excep-
tion of Exploration and Production (E&P), are not reserved to the State.
In oil-related exploration and production there are six main opportu-
nities in the short and medium term (even under the current legisla-
tion) and in natural gas there are three main opportunities. There are
also opportunities in the domestic market and in the trading and
supplies sector.
When posing the question as to what to change, institutionally-wise
three priority actions must be tackled: 1) the entity that shall regu-
late hydrocarbon activities must be created, 2) the National Energy
Commission must be created (NEC), and 3) all the necessary steps to
have a modern ministry of energy must be taken.
The national government shall be required to send sings of stability
and legality to generate trust in the world with respect to investing
and working in Venezuela.
The following must be promoted and developed, responding to mar-
ket conditions: The Orinoco Oil Belt, proven oil reserves not devel-
oped in traditional areas, inactive areas, new areas for exploration
and future development, offshore gas fields as well as liquefied natu-
ral gas projects for export. The creation of companies must be fos-
tered to industrialize refining streams, as well as new petrochemical
facilities. Within the framework of the law we shall have to revise
any and all international agreements that are damaging to the na-
tion’s overarching interests.
The relationship between the State and society must be revised with
respect to the revenues produced by hydrocarbon activities, so that it
goes directly to the citizens.
Any and all bilateral agreements and conventions must be revised
and they must be conditioned to the best interests of the Republic;
proceeding must be initiated to modify the legislation related to hy-
drocarbons so as to facilitate the execution of the above mentioned
points.
PDVSA will have to stop being an operator and it will have to be con-
verted into an excellent administrator of shared production con-
tracts («Production Sharings»), on behalf of the owners of the resource,
which are all the Venezuelan citizens. On this, there are extraordi-
nary examples of the associations at the Faja, where PDVSA had less
than 50 % share and everything worked successfully. While the Or-
ganic Law on Hydrocarbons is modified with political clout the con-

cept of joint ventures may be used for said purposes, including
private parties with at least 49 % share in the business. Service con-
tracts may be signed for the current activities conducted by PDVSA as
well as in-house efforts.
The following short term measures must be taken (the day after):
1 State-owned PDVSA must maintain its current activities as «in-
house efforts», an activity that produced 1,764,400 b/d in 2014, or
60.9 % of the official production and the joint ventures which pro-
duced 1,143,700 b/d or 39.1 % of the official production for a total of
2,899,100 b/d;
2. the priority staff must be identified so as to guarantee continuity
of the operations;
3. Control must be taken immediately of the priority information sys-
tems such as operations, finance, international trade and payroll;
4. a permanent internal communications plan must be set up to re-
duce the levels of uncertainty in the personnel and to generate a
climate that is propitious for operational continuity;
5. Carry out technical–operational evaluations and on the adminis-
trative processes in the principal business areas and social re-
sponsibility programs;
6. Technical-financial audits, reservation audits, audits on the status
of the reservoirs and facilities must be conducted, as well as the
rigorous evaluation on the feasibility of enhancing production;
7. Secure highly-critical facilities such as refineries and fuel filling
stations, gas pipelines, gas compressing plants and gas dispatch-
ing centers;
8. Contact the national and international financial community to
guarantee compliance of the company’s commitments and en-
sure that the credit flows are maintained for a financially weak-
ened PDVSA; and
9. finally, the issue of managing human resources currently working
at the State-owned company. In 2002, PDVSA’s payroll was 39,354
workers of its own and 28,329 third-party contractors and was
downsizing. At present, based on figures in PDVSA’s 2014 report,
there were 147,126 employers, 30,320 of whom are not engaged in
the sector’s activities, and there are also 25,698 contractors.
Since day one, the ministry of petroleum and mining, jointly with
members of PDVSA’s board of directors designated for said purpose
must begin to give the necessary steps to take the NOI to a situation of
optimal development and performance. To carry forward the forego-
ing, the governability and operational normalcy of PDVSA and the
joint ventures is of the utmost importance.
2. Resources and reservesWe believe that we must expand on this issue because with the re-
sources and reserves of petroleum and natural gas available in the
nation shall be the basis for the proposals to rescue and re-launch the
national oil industry (NOI).
Regulating the concepts of oil and natural gas resources dates back
many years, the precursors of which were the American Petroleum In-
stitute (API), which in 1976 published a paper entitled «Organization
and Definitions for the Estimation of Reserve and Productive Capacity».
Next, the American Society of Petroleum Engineers (SPE) was very ac-
tive since 1981 on the subject matter, when its technical Journal of Pe-
troleum Technology presented the «definitions of proven oil reserves».
From then on, the society’s work has been permanent and consis-
tent, until the recent excellent 221-page paper of November 2011 enti-
tled «Guidelines for Application of the Petroleum Resource Management
System (PRMS)» which coordinated - with the support of the American
Association of Petroleum Geologists (AAPG), the World Petroleum
Council (WPC), sponsors of the World Petroleum Congress, the Soci-
ety of Petroleum Evaluation Engineers (SPEE) and the Society of Ex-
ploration Geophysicists (SEG).

Setting up the management system for oil-based resources (PRMS)
worldwide dates back to 2007. The topic of concepts and definitions of
hydrocarbon resources and reserves is so important that it has gar-
nered the attention of the United Nations, which since 2004 analyzes
the topic and publishes papers such as the 2009 United Nations Frame-
work Classification for Fossil Energy and Mineral Reserves and Resources.
Thus, the US Securities and Exchange Commission - SEC - the regulatory
agency of the United States which since 1934 was entrusted with the
mission of «protecting investors, and keeping the markets transpar-
ent, tidy and efficient to enable the creation of materials on oil and
natural gas resources and reserves to protect the shareholders of oil
companies», let us recall the case of the Royal Dutch Shell on which
the SEC imposed an enormous onus (389 million US$) to its sharehold-
ers and the destitution of the directors responsible for calculating
and presenting these reserves, which did not exist. It is no coinci-
dence that PDVSA has withdrawn from the SEC.
These international concepts and definitions on oil and natural gas
resources have been collected by the current ministry of petroleum
and mines of Venezuela in its «Definitions and Standards for Hydrocar-
bon Reserves- Exploration and Production Department».
One thing is to have resources and even reserves and another is to be
in the real capacity to produce them, which is the tragedy of the ma-
jority of OPEC nations, and especially Venezuela, whose government
never tires of repeating that we are the country with the largest oil re-
serves in the world, most of which is located in the Orinoco Oil Belt.
It is important to recall that the numbers of proven oil reserves in the
Orinoco Oil Belt derived from a presidential whim in 2007 which con-
sisted in multiplying a value of original oil in place (OOIP) of 1,360
billion barrels by an exaggerated recovery factor (RF) of 19 % which
resulted in 257.4 billion barrels. The sad origin of this high recover
y factor was explained in my Barriles de Papel (in English, Paper Barrels) issue
No. 18.
At the democratic PDVSA an OOIP value was established for the Faja of
914 billion barrels and the declared proven oil reserves were 37.1 bil-
lion barrels, using a moderate and more reasonable RF of 4.1 % (Aníbal
Martínez, 2004, La Faja del Orinoco, Editorial Galac).
For the foregoing reasons, the brunt of oil reserves presented to the
nation and the world by PDVSA, which correspond to those in the Ori-
noco Oil Belt do not comply with the Petroleum and Mining Depart-
ment Standards of Venezuela nor with the international regulations,
and cannot therefore be considered as proven oil reserves.
3. The future of hydrocarbons worldwidea. PetroleumWe must recall that nowadays, oil that is not refined is worthless.
From a typical refining process 47 % gasoline is obtained as well as
23 % of diesel and fuel oil and 10 % jet fuel, meaning to say that 80% is
used for transportation. Insofar as transportation is catered to by re-
newable energies and become energetically more efficient, land
transportation, vessels and airplanes will need less oil byproducts.
The main worldwide forecasters, including institutions (IEA, EIA,
OPEC, WEC, among others) as well as the oil companies (ExxonMobil,
Shell, BP) and more recently the Russian Science Academy, estimated
an oil share in the world energy matrix of 23 % to 31.8 % for the 2035-
2040 period, the OPEC estimate being 24.3 % for 2040. This is what we
have taken to calling «the window of opportunity for Venezuelan
petroleum».
b. Natural gasNatural gas has a greater future than petroleum, since it is the least
contaminating fossil fuel and there are plenty more resources (prin-
cipally shale gas and gas from seabed hydrates) and is being called
upon to replace coal to generate electricity and in many cases oil by-
products in transportation. As we have seen, Venezuela has huge re-
sources of this hydrocarbon.

4. Hydrocarbon resources and reserves in VenezuelaThis is what we have been writing about and saying about the oil and
natural gas reserves in Venezuela: one thing is to have the resources
and reserves and another is to have the real capacity to produce
them, and this is the tragedy in the majority of OPEC nations, and es-
pecially Venezuela, whose government never tires of stating that we
are the nation with the largest petroleum reserves in the world. With
respect to these official figures of proven oil and natural gas reserves
in Venezuela, the situation is critical: PDVSA’s 2014 performance re-
port emphasizes that of the enormous volumes of proven oil reserves
announced, barely 4 % of the oil reserves have been developed (or
have the proper infrastructure to produce them) and the rest needs
thousands of new wells, new gas collecting stations and gas com-
pressing plants, new oil and gas pipelines and new storage yards and
docks. In other words, an entire set of infrastructure totaling billions
of dollars, which must be very well designed and be ready on time for
this new petroleum to be produced.
Likewise, according to PDVSA, the official proven natural gas reserves
are 196 billion (1012) cubic feet (tcf), only 19 % of which has been devel-
oped, 31.64 tcf of which are located offshore and 11 years after the en-
actment of the Organic Law on Gaseous Hydrocarbons, still not
an ounce of substantial production of natural gas has come out of
those fields for sale in the domestic market, and much less for export.
We have heard that production in the Delta Platform shall be sent to
Trinidad &Tobago for processing and the natural gas resources to be
explored and developed on-land and offshore total 200 tcf.
In regards to the Venezuelan reserves, table 1 and 2 explain that for
production calculation purposes the reserves in traditional areas
(«conventional crude oils») totaling 76,000 million barrels should be
more than sufficient. The above mentioned number includes the 4
associations at the Faja with a moderate and producible recovery fac-
tor. However, considering that several of my colleagues doubt those
developed and non-developed reserves as of 1998, and being conser-
vative, I suggest for calculation purposes a figure of 43,000 million
barrels which, for all intents and purposes are more than the aggre-
gate proven oil reserves of Mexico, Brazil, Colombia, Argentina, Ecua-
dor and Peru . That volume of proven oil reserves could result in a
production close to 4,000,000 b/d during the next 30 years.

5. The rest of the value chain in the national oil industry (NOI)
The value chain in the NOI begins at the exploration and production
phase (E&P). In general the NOI-related discussions and proposals
usually revolve around the «upstream activities», meaning to say E&P.
After E&P activities come the manufacturing (refining, enhancement
of the Orinoco Oil Belt crude oils, and the processing of natural gas) of
the produced hydrocarbons including natural gas, followed by trans-
portation and storage; domestic and foreign trade; those inherent to
the domestic market, continuing on with research, development and
training, to finally end up with the no less important ones of busi-
nesses abroad. By law, all these activities, with the exception of E&P,
are not reserved to the State, meaning to say that they could be un-
dertaken by the private sector «jointly or not with the State-owned
companies», as stated in our hydrocarbons-related legislation.
This means that with the proper political clout an entire array of op-
portunities is opened for the full development of the NOI with the
participation of the national and international private sector, a topic
we shall expand on later on.
Specifically in regards to the refining infrastructure, for the purpos-
es of «energy security», with the proper maintenance and upgrades
the nation’s 6 refineries and Isla could supply the domestic market
and there would be a surplus left over for export. The adjusted re-
serves can easily meet these requirements. More details are offered
in table 3. The management of the refineries shall be dealt with in a
later chapter, as well as the above mentioned businesses.

6. The national oil industry (NOI) in 5 stagesTo conduct any analysis of the future of the NOI, we must go back to
the immediate past to try to pinpoint the statization (or nationaliza-
tion) of the NOI in 1975 within the framework of the nation’s oil pro-
duction since 1970. Nationalization took place five years after the
greatest production boom and later went into free fall for 15 years
(1971-1985), during which time there was an attempt of recuperation
until 2001, when the production levels of 1973 were once again
reached, and the plans pointed towards surpassing the levels in 1970.
When nationalization happened in 1975, the nation closed that
year with an average production of 2,346,202 b/d, although in De-

cember of that year it was 1,772,000 b/d… Perhaps an effect of the
nationalization?
From 1970 to 1985, when the average production for this latter year
reached 1,681,045 b/d, production began to drop… What happened in
those 15 years? …All we saw was production continuously dropping!
In 1997, production rose once again above the three million barrels
per day (to be exact that year the average production was 3,160,000
b/d) reaching a ceiling of 3,342,000 b/d in 2001. From 2002 to date, pro-
duction has not increased. By 2014, State-owned company PDVSA re-
ported an average production of 2,779,000 b/d, although OPEC sources
state that it was only 2,373,000 b/d. By September 2015, PDVSA report-
ed to the OPEC an average production of 2,630,000 b/d, although sec-
ondary OPEC sources say that it was only 2,369,000 b/d.
These changes in oil production levels would affect natural gas pro-
duction levels (since it is associated to petroleum) and the manufac-
turing and processing of petroleum and natural gas, as well as
exports, and of course, NOI finances.
On August 29, 1975 President Carlos Andrés Pérez Rodríguez signed
the «executive order» on the 28 articles containing the law reserving
the industry and trading of hydrocarbons to the State, a law that
would be enacted as of January 1st, 1976. PDVSA was created on August
30, 1975, per decree No. 1123.
This decision, more political than not, was reached after notorious
nationalization processes. We say it was political and not economic
because the PODE 1975 (page 128) informed that the relationship of the
State’s participation in the profits of the companies was 94 % and the
summation of the income tax revenues, royalties and other taxes to-
taled 6,785.9 mmUS$ or 78.64% of the total revenues of the companies
(8,628.6 mmUS$). Here are the facts:
1. A policy of no more concessions, drafted since 1945;
2. With the 1945-1948 tax reform, the government’s revolutionary
board established the legal concept of 50 %-50 % distributed gains
between the licensees and the State. This ratio would be increased
to what was known as 60 %-40 % through the tax reform by the
1958 government junta;
3. The commission to coordinate the conservation and trading of
hydrocarbons was created on April 9, 1959 for the defense of prices
and to avoid the economic pilfering of petroleum (Juan Pablo Pérez
Alfonzo-JPPA);
4. State-owned company Corporación Venezolana del Petróleo (CVP
for its acronyms in Spanish) was created on April 19, 1960 as a na-
tional company managed by Venezuelans for Venezuelans (JPPA), as-
cribed to the ministry of mines and hydrocarbons;
5. The 1943 Law on Hydrocarbons was amended on July 20, 1967 to in-
troduce the concept of service contracts negotiated by the minis-
try of mines and hydrocarbons or the CVP;
6. The regulations on the conservation of hydrocarbon resources
was passed on February 11, 1969, a strictly technical first-rate
document;
7. On April 11, 1969 the Venezuelan Society of Petroleum Engineers
(SVIP for its acronyms in Spanish) conducted a successful Forum on
Reverting Oil Licenses as of 1983;
8. On July 30, 1971 President Rafael Caldera enacted the Law on As-
sets Subject to Reversal of Hydrocarbon Licenses. The nation was pre-
paring to forward the date of the reversal of the majority of the
licenses;
9. On August 26, 1971 President Rafael Caldera enacted the Law Re-
serving the Natural Gas Industry to the State, which compelled
licensees to hand over all the natural gas produced by them to the
CVP and the executive branch of power was to decide on the use
thereof in production operations (fuel, injection, processing, etc.);
10. On January 28, 1973 the minister of mines and hydrocarbons an-

nounced that the Orinoco Oil Belt would not be negotiated with
any nation and that all future domestic oil developments would
be conducted by the CVP, and
11. The Law Reserving the Exploitation of the Domestic Market (DM) for
Hydrocarbon Byproducts to the State was enacted on June 21, 1973
stating that all DM activities would be hereinafter managed by
the State-owned company.
At year-end 1975 the proven oil reserves were 18,511 million barrels.
An average 2,346,202 b/d were produced that year of an average API
gravity of 25.9o API, the same levels as in 1956. Of that total volume,
38.5 % were 30.1o API or more (light crude oil and condensate), 34.5 %
was 22.1 to 30o API (medium crude oil) and the remaining 27.1 % was
lower than and up to 22.0o API (heavy and extra heavy crude oils).
The 12 operating refineries had a processing capacity of 1,554,000 b/d
of operation. 865,855 b/d of crude oils and blends were processed and
oil and oil byproduct exports (1,472,178 b/d and 613,970 b/d respec-
tively) were 2,086,148 b/d. Gasoline consumption was 105,286 b/d. Ex-
ports took place at a price of 10.99 US$/barrel for petroleum and 11.0
US$/barrel for the byproducts.
7,535 mmUS$ of the total regular fiscal revenues (9,738 mmUS$) came
from oil (77.4 %) as well as 95.6 % of exports (page 1, PODE 1975).
In 1975, the personnel of the NOI was 23,733 employees, 23,248 of
whom were nationals and 485 foreigners. The average annual remu-
neration in 1975 was 1,948.4 million bolivars or 82,097 Bs. Per year per
employee, which at the exchange rate for 1975 of 4.20 Bs./US$ was
19,546.9 US$ per year per employee.
2001 was the year when oil production closed at its highest level after
nationalization; the average production for the year was 3,342,000
b/d, similar to the levels in 1963-1964, with an average API gravity of
23.5o API. 43.6% of that volume was less than 21.9o API (heavy and ex-
tra-heavy crude oil); 35.1 % was of 22.0 to 29.9o API (medium crude oil)
and 21.3 % was 30.0 or more API (light and condensate). It can be
observed how the quality of production had gone down compared to
1985. By 2001 the production of the operation conventions was
502,011 b/d and production at the 4 associations in the Orinoco Oil
Belt was 233,200 b/d (the upgraders were activated as of February
2001). As of the end of 2001 the proven oil reserves were 77,783 million
barrels.
During the 1999 - 2014 period the increase in «conventional crude oil
reserves» was very modest. The extravagant increase was attributed
to extra heavy crude oils, especially from the Faja del Orinoco field. In
1998 the total reserves were 35,647 million barrels (mmbls), mostly
from the Faja, which corresponded to the 4 strategic associations and
bitumen from Bitor. By 2014, the increase in reserves from the Faja
was excessive, and in reality are not reserves, as was previously ex-
plained. Due to this reason my proposal is that this exaggerated
number not be considered for any calculation whatsoever, since in
any case the 76,000 mmbls is more than sufficient for the purposes of
production. See more details on table 1.
As previously explained (see our Paper Barrels issue Nos. 95, 70, 61 and 18 on
http://www.petroleum.com.ve/barrelsdepapel/), of these «conventional re-
serves», PDVSA informed that for 2014 only 23.87 % of crude conden-
sates were scarcely developed; 17.02 % of light crude oils, 17.83 % of
medium crude oils and 24.2% of heavy crude oils. Thus, only
19.01& % of the natural gas reserves were developed. More details
are offered in table 2.
These reserves were not developed because the wells to produce
them are nonexistent, and neither the necessary production facili-
ties, gas compression plants or oil and gas pipelines. In order to devel-
op the non-developed reserves huge investments and know-how,
technology, specialized human resources and clear rules of the game
are required.
The 1998-2008 plan, the last one of the democratic PDVSA, was aim-
ing for 5,600,000 b/d, 3,550,000 b/d of which would be from in-house

efforts in the traditional areas, 70,000 b/d in the areas under conven-
tions and agreements and 1,300,000 b/d from third-party efforts at
the Faja jointly with the CVP, all of which were totally reasonable vol-
umes. All of this with 41,100 million barrels of proven oil reserves.
The free fall in 15 years we referred to above happened for three
reasons:
1. First of all, the political inconvenience of no more licenses, which
cancelled all exploration activities with the subsequent loss of re-
serves, which dropped to levels as low as 13,810 million barrels in
1973. This was repeatedly denounced by the visionary engineer
Arturo Hidalgo R (see our Paper Barrels issue No. 132). Due to the mistaken
concept rooted in our political class in which petroleum had to be
kept and conserved, they understood how not to produce it, when
the concept of conservation is purely technical because it refers to
the conservation of reservoir energy.
2. The OPEC’s mistaken quota policy of quotas. The recently de-
ceased Erwin Arrieta, former minister of energy (1994-1998) and
chairman of the OPEC Conference (1995) was said to have uttered
the following phrase: «The organization is a Club of Pinocchios».
The official oil production value for 2014 closed at an average rate of
2,779,000 b/d, the same levels as in 1995, but the OPEC placed it at the
levels of 1991 (2,381,000 b/d), and an average API gravity of 20.5o API.
54.32 % of that volume was less than 21.9o API (heavy and ex-
tra-heavy); 24.54% was between 22.0 and 29.9o API (medium) and
21.14 % was 30.0 or more o API (light crude oil and condensate). Notice
how the quality of production had gone down compared to 1975. In
regards to human resources the total payroll was 147,126 persons, of
whom the State-owned company recognizes that 30,320 are engaged
in non-oil activities.
Forty years after the nationalization of the national oil industry the
situation could not be worse:
1. At the time of the nationalization the income tax revenues, royal-
ties and other taxes combined totaled 6,785.9 mmUS$, 78.64 % of
the total revenues from companies (8,628.6 mmUS$). For reference
purposes, in 16 years during the 1999-2014 period this percentage
was barely 19.9 %;
2. The official «proven oil reserves» are 86.26 % extra heavy crude oils
(258,739 million barrels-mmb), 255.958 mmb of which are in the
Orinoco Oil Belt field and the bulk of it does not comply with the
standards, and are therefore resources. A more reasonable num-
ber for the proven oil reserves for Venezuela could be 76,108 mmb,
and for practical purposes it would be better to consider only
43,000 mmb;
3. In 2014 the official average oil production closed at 2,779,000 b/d,
similar levels as in 1995, but the OPEC places them at the levels of
1991 (2,381,000 b/d)
4. Production is increasingly heavier, at an average API gravity of
20.5 o API. At the time of nationalization the average gravity was
25.9 o API;
5. Accidents and incidents at the refineries and oil spills are occur-
ring every day;
6. PDVSA’s commissar informed that as of the end of 2014 the compa-
ny’s financial debt was 46,153 mmUS$, while at year-end 1998 it
was barely 7,102 mmUS$, and worse yet, this indebtedness was not
used to increase investments at the State-owned company;
7. Regarding human resources the total payroll in 2014 reached
147,126 persons, of which the State-owned company recognizes
that 30,320 engage in non-oil activities. We must recall that at the
time of nationalization the NOI personnel was barely 23,733 em-
ployees, and the production was 2,346,202 b/d, similar to that in-
formed by the OPEC in July 2015.

7. Business opportunitiesThere are many business opportunities throughout the entire NOI
value chain (figure 1), for the simple reason that all the activities,
with the exception of Exploration and Production (E&P), are not re-
served to the State.

In Exploration and Production there are main short- and medi-
um-term opportunities, even under the current legislation:
a. Proceed to develop the non-developed proven oil and natural gas
reserves in the traditional areas. This includes the thousands of
inactive wells, classified by the ministry of petroleum and mining
as «shut down but capable of producing», which will have to be re-
placed by wells using new production technology;
b. Grant the necessary service contracts for the entire service opera-
tions infrastructure activities;
c. Grant the necessary permits for the collection and sale of the pro-
duced gas;
d. Increase the recovery factor of the reservoirs;
e. Grant the resources (prospects) existing on land and offshore for
their exploration and eventual development;
f. Proceed to develop the non-developed reserves at the Orinoco Oil
Belt field, permitting the free use of the 13 technologies to exploit
them and the 5 technologies to market the production.
There are three main opportunities for natural gas:
a. Grant the necessary permits for the construction and mainte-
nance of the transportation infrastructure (gas pipelines) re-
quired to upgrade and increase the distribution of methane gas;
b. Grant the necessary permits for the distribution and trading of
gas through pipelines at the main towns and hamlets;
c. Grant the necessary permits for the processing, storage and dis-
tribution of gas in gas tanks (LPG).
In the domestic market the obvious opportunity is to grant the re-
quired permits to fill the nation with gas stations and convenience
stores.
In trade and supplies the opportunity is to grant the required permits
for domestic and foreign private parties to trade with crude oils and
byproducts, nationally and internationally.
Also in training there are many opportunities.
8. What needs to changea. At the institutional levelInstitutionally-wise, three priority actions must be taken:
a. Proceed to create the hydrocarbons regulatory entity, a State
agency, independent from the government currently in place, au-
tonomous and autarchic, responsible for the administration, im-

plementation and overseeing compliance of the corresponding
public policies, and regulating the activities; granting the licenses
and permits to open all the «upstream and downstream business-
es», keep statistics, apply fines, calculate and distribute royalties,
among other activities.
b. Proceed to create the National Energy Commission, a State agen-
cy, independent from the government currently in place, autono-
mous and autarchic, an entity responsible for drafting public poli-
cy proposals for the energy sector and ensure the success of its
purpose and objectives. In order to guarantee a balance in the im-
portant decisions and orientation of the NOI activity the National
Energy Commission must incorporate a significant representa-
tion of Venezuelans, above and beyond State representatives,
such as companies, financial entities, academies, universities,
unions and associations and civil society groups linked to the sec-
tor, among others, following an organizational and working
scheme as the one found in the successful U.S. National Petroleum
Council-NPC.
c. Take all the necessary measures to have a Modern ministry of en-
ergy, entrusted with presenting public policy proposals to the Na-
tional Assembly, promote research and development in the sector
and representing the nation at international energy-related af-
fairs. By law, the posts of minister of energy and chairman of the
State-owned oil company shall be prohibited from being held by
the same person, thereby rescuing the role of the ministry of ener-
gy as the rector of the country’s energy and oil businesses and the
guarantor of its energy security. Additionally, all the offices, agen-
cies and commissions to communicate with the citizens and
guarantee their rights shall be ascribed to the ministry of energy,
especially the company’s freedom, respect for private entities and
information transparency. The essential characteristic of these
agencies shall be their independence from the executive branch of
power, meaning to say from the government currently in place
(even though they are state dependencies). It shall foster and en-
dorse applied research and development on renewable and
non-renewable energies and promote studies at private universi-
ties and institutions in the fields of petroleum, geology, hydraulic
basins, renewable energies, fuels, and other uses. It shall be re-
sponsible for all official publications containing national and in-
ternational historical information on energy and its relationship
to the economy of Venezuela and worldwide (the current Petróleo
y Otros Datos Estadísticos-PODE, which has been published for 50
years).
The relationship among the proposed entities is shown in schematic
form in figure 2:

In parallel:
a. The national government shall be required to send to the world
signs of stability and legality so as to generate trust. Contractual
commitments with partners must be faithfully met, to avoid law-
suits and face the growing number of arbitrations, a situation
which besides affecting the prestige and seriousness of Venezue-
la, impacts productivity in the oil industry.
b. Take the necessary steps to thrust forward the national oil indus-
try (NOI) throughout all the phases of the business: Exploration
and Production (E&P), Manufacturing (refining, upgrading and
processing), Natural gas, Domestic and foreign trade, and busi-
nesses abroad; considering that in the current legislation only E&P
activities are reserved for the State.
c. We could begin with the permits policy to install gas stations and
convenience stores for whoever requests them, as well as with the
permits for private parties to fully participate in the regional dis-
tribution of methane gas and gas in gas tanks, promoting the de-
velopment of the gas sector through the private sector for the con-
struction and maintenance of the natural gas transportation
systems (gas pipelines) and distribution networks in as many
towns and hamlets as possible.
d. Responding to market conditions the following must be promoted
and developed: The Orinoco Oil Belt, undeveloped proven oil re-
serves in traditional areas, inactive areas, new areas for explora-
tion and future development, offshore gas and liquefied natural
gas for export.
e. Promote the creation of companies to industrialize refining
streams, as well as new petrochemical plants.
f. We shall have to revise, within the framework of the law, any and
all international agreements which are deleterious to the nation.
g. Take the necessary steps to start the process of adjusting the pric-
es of all the fuels and revise the policy of subsidies.
h. The relationship between the State and Society must be reviewed
with respect to the revenues produced by hydrocarbon activities,
so that it goes directly to the citizens. The economic surplus aris-
ing from oil activities corresponding to the nation must be fully al-
located to creating a FUND, which shall be a savings, patrimony
and investments fund for all the Venezuelan people. Its perfor-
mance yield shall be handed out directly to every Venezuelan
through individual accounts. The Fund shall be managed autono-
mously by a qualified representation of Venezuelans, and its ad-
ministration shall be in the hands of the most solid national and
international financial entities.
i. All bilateral agreements and conventions will have to be reviewed
and conditioned to the best interests of the Republic.
j. The process to modify the hydrocarbon-related legislation must
be started so as to enable the execution of the above mentioned
items.
k. The sciences and technologies must be developed and opportuni-
ties created for research and development throughout the entire
offer and supply system stages of the energy sector.
b. Relations among owners of the resource and private partiesWith respect to the relations among the owners of the resource and
private parties, allow me to recall that my proposal is for PDVSA to
cease being an operator and become an excellent administrator of
production sharing contracts («Production Sharings») on behalf of the
owners of the resource, meaning to say, all the Venezuelan citizens.
On the foregoing we have extraordinary examples from the associa-
tions at the Faja, where PDVSA had less than 50 % share and it all went
successfully. While the Organic Law on Hydrocarbons is amended
through a proper political will, the legal concept of joint ventures can
be used for said purpose, by means of private parties holding at least
49 % of share in the business.

Service contracts could be signed for the current activities conduct-
ed by PDVSA as well as in-house efforts.
9. Short-term proposals («The day after»)PDVSA has ill intentionally not presented the volumes of crude oil
processed at Venezuelan refineries in its 2014 performance report:
only the sum total of domestic and international refineries. Neither
has it shown the load of the refineries per type of crude oil. Therefore,
for this analysis we have resorted to the 1998 and 2012 PODE reports
from the ministry of petroleum and mining, as shown in table 3.
It is worthwhile noting that in the 15 years of the current regime, the
volume of processed crude oils, as well as the contribution by light
crude oils (-205.000 b/d) and dropped and the other supplies which
are imported have increased by 22.600 b/d. Concrete actions must be
proposed to guarantee energy security (reliable fuel supplies – gaso-
line, diesel, fuel oil, gas in gas tanks and methane gas coming through
pipelines – for the electric, transportation and industrial, commer-
cial and residential sectors) by means of measures tending towards
achieving governability and operational normalcy at PDVSA and the
joint ventures. This is part of the premise of the serious deterioration
at our principal industry and the pressing need to enhance its effi-
ciency and efficacy, using a model that is different to the previous one
and the currently existing one.
In the short term, the State-owned oil company must maintain the
activity it conducts nowadays as «in-house efforts», an activity that
produced 1,764,400 b/d in 2014, which was 60.9 % of the official pro-
duction; Joint ventures produced 1,143,700 b/d or 39.1 % of the total of-
ficial production of 2,899.100 b/d.
table 4 shows the consumption of refined products from 2005 to
2014, indicating that major operational efforts must be made espe-
cially to produce gasoline, diesel and fuel oil (592 thousand b/d) and
asphalt (10.4 thousand b/d), as well as gas in gas tanks-LPG (91 thou-
sand b/d) and methane gas through pipelines (1,537 mmscf/d).

In COENER’s Comunicados we stated that the following should be im-
plemented:
a. Identify the key personnel to guarantee continuity of operations;
b. Take immediate control over priority information systems such
as operations, finance, international trade and payroll;
c. Set up a permanent internal communications plan to reduce un-
certainty among the personnel and generate a climate propitious
to operational continuity;

d. Conduct technical–operational evaluations and on the adminis-
trative processes in the main areas of the business and to the so-
cial responsibility programs;
e. A technical financial audit needs to be conducted as well as au-
dits on the reserves, the status of the reservoirs and facilities, and
a rigorous evaluation to the feasibility of increasing production;
f. Secure highly critical facilities such as refineries and fuel filling
stations, gas pipelines, gas compressing plants and gas dispatch-
ing centers;
g. Contact the national and international financial community to
guarantee compliance with the company’s commitments and
ensure continuous credit flows for a financially weakened PDVSA.
To carry forward the foregoing, as previously stated, the governabili-
ty and operational normalcy of PDVSA and the joint ventures must be
attained:
In terms of governability, a pact must be struck among the various
political players contemplating the non-interference of the executive
branch of power in operation activities or the designation of the exec-
utives, save for the appointment of the board of directors for the
home office. A labor peace agreement with union leaders shall also
be indispensable. Likewise, continuity of business with properly con-
tracted and committed partners, contractors and vendors must be
ensured.
With respect to operational normalcy, the immediate objective is to
guarantee that the production of oil and natural gas and refining do
not continue to drop; that there are less accidents and that trading
and hiring of third party contractors be done in a transparent man-
ner. For this purpose, respect of the personnel currently working in
these activities is crucial. During this stage an excellent relationship
with the union leaders is of vital importance as well as complying
with the safety at work and occupational hygiene norms and re-
specting the environment.
To return to a full operational normalcy the individuals and legal en-
tities that have been affected must receive proper reparation, and
the payment terms for the required compensations must be agreed
upon. The priority shall be the official acknowledgement of all the
debts and commitments with the personnel illegally expelled in
2002 and 2003.
The designation of a new board of directors must inspire trust in the
employees of the NOI, as well as in Venezuelan society. For this, the
new directors must be recognized for their honesty, equanimity,
knowledge of the business and managerial capacity. This board of di-
rectors will be entrusted with reorganizing the company and en-
hance its efficiency and efficacy.
Finally comes the topic of managing the human resources currently
working at the State-owned oil company. In 2002, PDVSA had a payroll
of 39,354 direct employees and 28,329 third-party contractors and
was downsizing. At present, based on figures in the 2014 PDVSA per-
formance report, there are 147,126 workers, 30,320 of whom are not
engaged in activities of the sector, apart from the 25,698 contractors.
We consider that the workers recruited who have good credentials
after 2002 should only be demanded not to participate in party-bi-
ased political activities inside the company. Any workers who are not
qualified must undergo an intensive training period.
All the trampled labor rights of the employees who were illegally
fired in 2002-2003 must be recognized. Their return to the State-
owned company shall depend on its needs and whether they are in
the professional capacity to return. Those who have reached the age
for retirement must receive their pensions.
PDVSA currently has 118 production units, 28 companies and 6 indus-
trial groups not related to the hydrocarbons business, organizations
that have nothing to do with the mission of a true oil company. These
organizations and their personnel must be progressively transferred
to connected official agencies. Employees of non-oil subsidiaries may

c. Issue all the necessary measures to thrust forward the accelerat-
ed development of the production of natural gas to fully meet the
needs of the thermoelectric park.
d. Guarantee operational continuity, permitting joint ventures to
produce to their fullest capacity (letting them work) and promot-
ing a financial policy applied on Campo Boscán, permitting pri-
vate parties to trade the produced crude oil and repatriate their
capitals (as in Cuba and other oil nations).
e. Establish clear rules to attract national and foreign capitals, know-
how and technologies which will be needed to fully develop the hy-
drocarbon resources.
f. Proceed to develop the undeveloped proven oil and natural gas re-
serves; increase the recovery factor of reservoirs and grant exist-
ing on-land and offshore resources (prospects);
g. Proceed to develop non-developed reserves at Campo Faja del Ori-
noco, permitting the free use of the 17 technologies to exploit
them and the 6 technologies to trade them.
10. Medium-term proposalsWith respect to production, we have insisted that the volumes to be
produced must firstly be determined by what is required to ensure
the nation’s «energy security» (the domestic market) and what the in-
ternational markets need for export purposes. Each and every licens-
ee shall use and take advantage of what is most convenient to them,
insofar as they expand their markets. In regards to the foregoing we
have to highlight that the regulating entity - and least of all the gov-
ernment currently in place - must meddle in these decisions taken by
private parties (OPEC, geopolitical commitments dixit). If the govern-
ment wishes to negotiate petroleum for any political reason they
could do so with a portion of the royalties corresponding to it as has
been done in the past (recalling that the bulk thereof must go to the
Fund for the citizens).
be liquidated and assigned to state and/or government organizations
relating to their jobs. There are 2,607 retirement-age employees at the
non-oil subsidiaries, so the critical situation for moving them is re-
duced. In any case this must be one of the first audits that will have to
take place so as to seek solutions to this situation, under the advice of
an organization development agency which must be created forth-
with during the transition period.
Summarizing, the Republic of Venezuela must:
a. Attain governability at PDVSA. A pact must be struck among the
various political players contemplating the non-interference of
the executive branch of power in operation activities or in the des-
ignation of the group of directors and managers, save for the ap-
pointment of the board of directors for the home office. A labor
peace agreement with the union leaders shall also be indispens-
able. At the oil subsidiaries, 40,124 employees are 45 years or older,
and 13,597 of these are already of a retirement age (see » 6). Insofar as
there shall be more private companies willing to pay their employ-
ees in dollars and sign better labor bargaining agreements than
PDVSA’s collective labor contract, the rest of the work-age employ-
ees would little by little resign from PDVSA and start working at
these companies, and this is valid for both payrolls. We must bear
in mind that with clear rules, respect for private property and the
rule of law, thousands of companies related to the hydrocarbons
business could set up offices in the nation.
b. Guarantee the nation’s energy security. «Energy security» implies
the short-term production of oil and natural gas of at least 573,000
b/d refined products (especially gasoline and diesel, including
10,000 b/d of asphalt), 90,000 b/d of liquefied petroleum gas (gas in
gas tanks) and 3,000 mmpc/de of methane gas. PDVSA and private
parties shall each have an aliquot of this production to send to re-
fineries and meet the needs of the domestic market

they have remained inactive, and will have to be completely re-
placed with new wells. Many of these wells are in totally inactive
fields, which should be granted out in service contracts and later
on through licenses, but the majority are in PDVSA production ar-
eas, making it difficult to be assigned individually but they could
be placed under joint ventures which would also manage the
neighboring active wells (the case of Boscán and Dación fields are
emblematic of this model). During the 1st. Round 177 wells of
these Wells were «reactivated»; 1,627 in the 2nd. Round and 1,635
in the 3rd. Round for a total of 3,439 wells. Many were replaced for
new wells.
Our proposal is that PDVSA slowly assigns all its areas under the le-
gal concept of service contracts (operational conventions or agree-
ments) until the Hydrocarbons Law is amended to pass every-
thing to production-sharing agreements (PSA).
4. Exploring and developing the as yet undiscovered resources on-
land and offshore. This was the case of the 8 areas granted under
the legal concept of exploration at your own risk and shared prof-
its, in which PDVSA could have up to 35 % share, based on the legal
concept of Profit Sharing, meaning to say that the State-owned
company used its percentage on CAPEX and OPEX. This is the basis
for our Production Sharing proposal in which the owner of the re-
source does not pay for CAPEX and OPEX expenses and only shares
a percentage of production with the specific partner. These legal
contracts have been explained very well in our Paper Barrels No. 86
and 87.
Three of the 8 areas handed out during the bidding process were suc-
cessful (La Ceiba, Golfo de Paria Este and Oeste), or an exploration
success of 37.5 %, which is very good for this activity. The opportunity
is clear because there are more than 650 prospects for the regulating
entity to offer and private parties interested in seeking light crude
oils for their markets and refineries in these traditional areas are
bound to appear.
During the 1999 – 2014 period, the production of the most commer-
cial crude oils has dropped alarmingly down: light crude oils have di-
minished by 817,000 b/d and medium crude oils by 518,000 b/d, which
explains the fall of these processed crude oils at domestic refineries
and the need to purchase more supplies from abroad (see table 3).
Factors to be taken into account to enhance production:
1. The first option is to develop the undeveloped proven oil reserves.
2. One second element to consider to estimate the future production
of petroleum is the «recovery factor», or the amount of oil that can
be recovered from the total oil in the reservoirs using the existing
technologies, human resources and at the current prices. In the
case of Venezuela, PDVSA has informed that the recovery factor of
condensates/light crude oils/medium crude oils is 30.23 %; the one
for heavy and extra heavy crude oils is 11.05 %, for a national aver-
age of 15.45 %. This national average is well below the estimated
international average (40%), which points to the great opportuni-
ties for increasing production by elevating the recovery factor of
the reservoirs in active and inactive areas.
3. The other factor to consider to enhance production is the number
of inactive wells in the areas operated today by PDVSA, a % of which
could be reactivated and, more importantly, in these areas of in-
fluence there are proven oil reserves which are there to be exploit-
ed by drilling new wells and using new production technologies.
The official figure of wells capable of being produced furnished by
the ministry of energy as of 12-31-2012 was 36,690, 17,678 of which
are in production (48.2 %) and 18,160 are shut down but are «capa-
ble of producing» (49.5 %, there are 2.3 % of drilled wells which had
been suspended). By 2015 this number must be larger. We have
clarified that this number of «shut down wells capable of produc-
ing» are not just going to be opened and that’s all. Some techni-
cians amongst us consider that thousands of those wells have
been lost (they cannot be recovered) due to the amount of time

The legal concept of «Production Sharing» has been successfully used
in many oil-producing countries and more recently in Mexico’s ener-
gy reform, and for the exploitation of «Pre-Salt» in Brazil.
To develop the natural gas resources the situation is easier because
this activity is not reserved to the State, so – once constituted - the
regulating entity must begin to offer all the rounds needed for the ex-
ploitation of the natural gas found offshore. The proposal for the new
NOI is shown in figure 3.

11. ConclusionsA proposal to rescue the national oil industry must guarantee «ener-
gy security», and this shall depend on committing to manage (with
the concourse of the best in the sector) the governability and opera-
To meet the needs of the domestic market, every producer would be
given a quota based on their production which they will have to hand
over to the refinery of their convenience, and jointly agreed upon
with the regulating entity.
The current administration has facilitated the task for the transition
through the creation of the new CVP, which was designed to manage
the upstream business of the State-owned company and not operate
them.
Since day one, the ministry of petroleum and mining, jointly with
members of the board of directors of PDVSA designated for said pur-
poses must begin to take the necessary steps to carry the NOI to a sit-
uation of optimal development and performance.
As previously stated, in the short term the State-owned company
must maintain the activity it carries out today as «in-house efforts»
as well as the joint ventures, but during the transition period the joint
ventures must increase their production to the max (PDVSA must let
them work) and the State-owned company must slowly reduce its
share of production. PDVSA must not expand further and must slowly
pass its «in-house activities» to service contracts (previously called
the operational agreements); thus, all inactive and new areas must
pass to the regulating entity for bidding first as joint ventures (51-49 %
as permitted in the Hydrocarbons Law) and when the law is amended
shall become production-sharing contracts in which the owner of
the resource, the citizens, do not have to invest (CAPEX) nor pay explo-
ration and exploitation OPEX. PDVSA must eventually become only
the administrator of the citizens’ resource and cease to be an opera-
tor, to lay to rest the phantom of «totalitarian temptation» which
drives away national and international investors. This temptation is
what we have been witnessing in Colombia with Ecopetrol, in Brazil
with Petrobras and in Peru with Petroperú, where State-owned com-
panies, after the success of private companies say they can do the
same and are not renewing the licenses, or in the case of Brazil, has
changed the law so that the State-owned company be the only opera-
tor in new areas and the partners have no say in this.

Summarizing, the following must take place:
i. In the very short term:• The designation of a new board of directors for State-owned com-
pany PDVSA must inspire trust in the NOI employees, as well as in
Venezuela society;
• From day one, the ministry of petroleum and mining, jointly with
the new members of PDVSA’s board of directors, must begin taking
the necessary steps to carry the NOI to a situation of optimal devel-
opment and performance;
• A pact must be struck among the various political players contem-
plating non-interference by the executive branch of power in op-
eration activities or the designation of the group of directors and
managers for the State-owned company;
• A labor peace agreement with union leaders is indispensable;
• The key personnel and posts to guarantee continuity of opera-
tions is of the utmost importance;
• Immediate control of the priority information systems must be
taken, such as operations, finance, international trade and payroll;
• A permanent internal communications plan must be established
to lower the levels of uncertainty in the personnel and generate a
climate propitious to operations continuity;
• Technical–operational audits must be conducted as well as on the
administrative processes in the main business areas and social
responsibility programs;
• Technical-financial audits, audits on the reserves, on the status of
the reservoirs and facilities, as well as the rigorous evaluation of
the feasibility of enhancing production must be carried out;
• Highly critical facilities such as refineries and fuel filling stations,
gas pipelines, gas compressing plants and gas dispatching cen-
ters, must be secured;
tional continuity of State-owned company PDVSA. Critical measures
will have to be implemented in the very short term (the day after), and
in particular the current partners in joint ventures must be allowed
to work since they are cable of maintaining and increasing produc-
tion in the shortest time possible. Energy-related policies must be de-
veloped to secure continuing production in the medium term or
transition period.
Venezuela must prepare to take full advantage of the «window of op-
portunity» remaining for oil as a protagonist in the world energy ma-
trix, and spearhead concrete measures to develop its natural gas
resources, a fuel with much more future than petroleum. All the fore-
going needs to count on the willingness of the groups of interest, es-
pecially the politicians, and they must understand that hydrocarbons
are not strategic nor are these basic industries and also that they have
nothing to do with the nation’s sovereignty or independence.
Venezuela has sufficient oil and natural gas resources to carry for-
ward the rescue of the national oil industry (NOI), which is so much
more than PDVSA. This rescue needs huge investments from nation-
als and abroad, as well as the participation of the best international
companies which would bring their know-how and technologies. To
guarantee the foregoing, the nation must offer clear signals that it
shall respect the commitments acquired, respect private property
and the rule of law, meaning to say that the rules must be very clearly
established. Regarding the economy the foreign exchange control
must be dismantled and the free expatriation of capitals must be
permitted. Labor-wise, the dozens of laws currently asphyxiating
private enterprise must be eliminated.
State-owned company PDVSA must cease to be an operator - to elimi-
nate the «totalitarian temptation» - and must become an excellent
administrator of the resource of all the Venezuelans, so that in the
name of these it enter into and manage any necessary contracts with
the national and international private sector, especially the service
contracts and production-sharing contracts, among others.

• The relationship between the State and society must be revised
with respect to the revenues produced from the hydrocarbons ac-
tivity so that it reaches the citizens directly;
• The processes to modify the hydrocarbon-related legislation must
commence so as to enable the execution of the above mentioned
items;
• The development of the sciences and technologies must be pro-
moted, creating opportunities for research and development
throughout the entire stages of energy sector offer and supply
systems.
b. Operations-wise:
• Attain governability and operational normalcy at PDVSA and the
joint ventures;
• In the short term, the State-owned company must maintain the
activity it currently engages in as «in-house efforts» and the joint
ventures must increase their production;
• Operational continuity must be guaranteed, permitting joint ven-
tures to produce to the max (letting them work) and promoting
the financial policy applied to Campo Boscán;
• Private parties must be permitted to trade the crude oil produced
and repatriate their capitals;
• Responding to market conditions, the following must be pro-
moted and developed: the Orinoco Oil Belt, undeveloped proven
oil reserves, inactive and new areas for exploration and future
development;
• PDVSA must allocate all its areas based on the legal concept of ser-
vice contracts (operation agreements) until the law on Hydrocar-
bons is changed to pass them all to production-sharing agree-
ments (PSA);
• The entire world must start receiving signs of stability and legality
that generate trust;
• The domestic and foreign financial community must be contacted
to guarantee compliance of the company’s commitments and to
secure continuous flows of credit to a financially weakened PDVSA;
• Respect for the relationships among the owners of the resource
and private parties.
ii. In the mid-terma. Institutionally-wise:
• The hydrocarbons regulatory entity must be created;
• The National Energy Commission must be created;
• A modern ministry of energy must be implemented;
• The necessary steps to thrust forward the national oil industry
(NOI) throughout all the stages of the business must be taken;
• Clear rules must be established so as to attract domestic and for-
eign capital, know-how and technologies which shall be needed to
fully develop the hydrocarbon resources;
• Bear in mind that with clear rules, respect for private property and
the rule of law, there will be thousands of companies related to the
business of hydrocarbons that will want to establish operations in
the nation;
• PDVSA must cease being an operator and become an excellent ad-
ministrator of the future production-sharing contracts and the
current activities conducted by PDVSA as in-house efforts must be
transformed into service contracts;
• All international geopolitical contracts must be revised and con-
ditioned to the best interests of the Republic;
• The price adjustment process on all fuels must begin and the sub-
sidies policy revised;

• All the necessary measures must be issued to thrust forward the
accelerated development of the production of natural gas to fully
attend to the needs of the thermoelectric park;
• The creation of companies must be promoted to industrialize the
refining streams as well as new petrochemical plants;
• The policy of permits for installing gas stations and convenience
stores for whoever requests them must become more flexible, as
well as all permits for the regional distribution of methane gas
and gas in gas tanks.
c. In regards to human resources:
• The situation of human resources currently working at the State-
owned company must be resolved;
• All the trampled labor rights of the employees illegally fired in
2002-2003 must be recognized and their return to the State-owned
company shall depend on its needs and if these are professionally
capable of returning. Those fit for retirement must be retired;
• All affected individuals and legal entities must receive reparation
and the modes of payment and compensations required must be
jointly negotiated;
• Recruited workers with good credentials after 2002 shall only be
demanded not to participate in party-biased political activities in-
side the company;
• Workers who are not qualified must receive an intensive training
period;
• The 118 production units, 28 companies and 6 industrial groups
not related to the business of hydrocarbons, organizations which
have nothing to do with the mission of a true oil company, and
their personal must be progressively transferred to connected of-
ficial agencies

Cedice Libertad, a través del Centro de
Estudios de Energía Venezuela, presenta
el siguiente trabajo, elaborado por Diego J.
González Cruz, que comprende una propuesta
con sus recomendaciones para emprender
el relanzamiento de la industria petrolera
nacional por una vía racional y segura.
Analiza los cambios institucionales que hay
que realizar, nos presenta planes para «el muy
corto plazo (The day after)», «el corto plazo» y
«el mediano plazo».
Es una contribución extraordinaria y de
obligatoria lectura y análisis, no solo para
quienes tengan interés en conocer lo que
ha ocurrido con la industria petrolera
venezolana, sino también para quienes
necesariamente tendrán la responsabilidad
de ocuparse de su reconstrucción.
