Lors d'une seance ordinaire du conseil municipal
de la Ville de Westmount, dument convoquee et
tenue a I'hotei de ville le 5 novembre 2018, et a
laquelle assistaient:

ATTENDU QUE la Loi sur I'ethique et ladeontologie en matlere municipale (RLRQ,c. E-15.1.0.1) oblige toute municipalite de se
doter d'un code d'ethique et de deontologiequi enonce les principales valeurs de la
municipalite en matiere d'ethique et les regiesqui doivent guider la conduite des employes de
celle-ci;
ATTENDU QU'un avis de motion se rapportant a lapresentation du present reglement a ete donne au
cours de la seance ordinaire du conseil municipalde la Ville de Westmount, dument convoquee ettenue le 15 octobre 2018;
ATTENDU QU'un projet de reglement a ete deposeau cours de la meme seance ordinaire du conseil
municipal;
WHEREAS the Municipal Ethics and Good
Conduct Act (CQLR c. E-15.1.0.1) requires allmunicipalities to have a code of ethics and good
conduct that sets out the main ethical values of
the municipality and the rules that must guide
the conduct of its employees;
WHEREAS Notice of Motion of the presentation
of this by-law was given at the regular sitting of
the Municipal Council of the City of
Westmount, duly called and held on
October 15, 2018;
WHEREAS a draft by-law was tabled at the same
regular sitting of the Municipal Council;

ATTENDU QUE, conformement a Tarticle 18 de la
Loi sur I'ethique et la deontologie en matiere
municipale (RLRQ, c. E-15.1,0.1), les employesde la Ville de Westmount ont ete consultes a
regard du projet de reglement le 19 octobre 2018;
II est ordonne et statue par le Reglement n° 1529,
intitule « REGLEMENT SUR LE CODE D'ETHIQUE ET
DE DEONTOLOGIE DES EMPLOYES DE LA VILLE DE
WESTMOUNT »que:
WHEREAS in accordance with section 18 of the
Municipal Ethics and Good Conduct Act (CQLRc. E-15.1.0.1), the employees of the City of
Westmount were consulted in regard to the
draft by-law on October 19, 2018;
It is ordained and enacted by By-law No. 1529,
entitled "BY-LAW ON THE CODE OF ETHICS AND
GOOD CONDUCT FOR EMPLOYEES OF THE CITY
OF WESTMOUNT' that:
Section I - Contexte et application Division i - Context and Scope
ARTICLE 1 SECTiON 1
Application
La Ville de Westmount est une municipalite
dont la mission et les services sont essentiels a
ses residents. Ainsi, dans le but de preserver laconfiance du public envers elle, le present code
encadrant la conduite de ses employes a eteprepare.
Dans le present code, le terme « employe »
designe toute personne travaillant pour la Vlllequels que soient son niveau hierarchique et son
statut d'emploi.
ARTICLE 2
Culture et valeur de ia Viiie
La culture interne de la Ville privilegie
I'excellence comme quaiite premiere devantregir ses rapports avec la collectivite locale.
Pour ce faire, la Ville a etabli une liste de
princlpes directeurs afin de guider sesemployes dans I'atteinte de cet objectif.
Scope
The City of Westmount is a municipality whose
mission and services are essential to its
residents. To preserve public trust in the city,
this Code is intended to guide the conduct of its
employees.
In this Code, the term "employee" means any
individual working for the City regardless of his
or her hierarchical level or employment status.
SECTION 2
The City's culture and values
Excellence is a core cultural value governing the
City's interactions with the local community.
Accordingly, the City has established a list of
guiding principles to be followed by its
employees in achieving that objective.

Les employes se conduisent de manierehonnete et evitent de se placer dans une
situation compromettante envers une
personne pouvant influencer leur travail.

Les employes exercent leurs fonctions avec
loyaute en defendant les interets de la Ville et
en evitant de lui causer quelque tort.

Lois, reglements, politiques et directives
Les employes exercent leurs fonctions dans le
respect des lois, reglements, politiques etdirectives applicables a la Ville.

Activites frauduleuses
Dans le cadre de leurs fonctions, les employesne peuvent participer a des activites
frauduleuses ou illegales
ARTICLE 8
Respect d'autrui
Les employes exercent leurs fonctions dans le
respect d'autrui, qu'il s'agisse de residents, debenevoles, de collegues ou de partenaires oufournisseurs de la Ville.
SECTION 4
Integrity
Every employee shall act honestly and avoid
compromising situations vis-a-vis any person
who could influence his or her work.
SECTION 5
Loyalty
Every employee shall perform his or her jobwith loyalty by defending the interests of the
City and avoiding harming it in any way.
SECTION 6
Legislation, by-laws, policies and directives
In performing their duties, every employee
shall comply with the laws, regulations, bylaws, policies, and directives applicable in theCity.
SECTION 7
Fraudulent activities
No employee may participate in fraudulent or
other illegal activities in performing his or herduties.
SECTION 8
Respect for others
Every employee shall perform his or her duties
with respect for others, be it residents,
volunteers, colleagues or City partners orsuppliers.

Confidentiality
Every employee shall respect the
confidentiality of all information made
available to him or her, and may communicateit only to a person authorized to be provided
such information.
A titre d'exemple, les renseignements sur les
residents, les benevoles, les employes et lesfournisseurs sont confidentiels. Les donnees
techniques ou financieres de la Ville sontegalement confidentielles.

Prohibited use of confidential information
Les renseignements confidentiels dont les
employes ont connaissance ne peuvent etreutilises pour obtenir un avantage pour eux-memes ou pour une personne liee.
On entend par« personne liee » des personnesunies par les liens du sang, de I'adoption, dumanage ou qui vivent comme conjoints de fait.
Ce terme s'applique aussi a toute entreprise ousociete dans laquelle I'employe ou sa parenteont un interet direct ou indirect.
No confidential information made available to
any employee may be used for personal benefit
or for the benefit of a related person.
In this Code, "related person" means an
individual related linked by blood, adoption ormarriage to an employee, or who is living in a
common-law relationship with an employee.This term also applies to any corporation orcompany in which the employee or any ofhis/her relatives has a direct or indirect
interest.

Les employes ont la responsabilite de prendre
les mesures necessaires afin que la
confidentialite de rinformation solt respectee.
Cet objectlf peut notamment etre atteint:
en ne laissant pas les documents contenantdes renseignements confidentiels a la vue
de personnes externes ou d'employes non
concernes;
Every employee is responsible for taking the
necessary measures to protect and maintain the
confidentiality of information.
This objective may be achieved in the following
ways:
- by ensuring that confidential documents
are not left in view of any outside person orother employees not involved;
en ne transmettant ces documents qu'aux
personnes autorisees a les recevoir;
en prenant des mesures physiques et
electroniques appropriees pour assurer la
protection des documents;
en ne discutant pas de ces renseignementsdans des endroits publics;
en utilisant des moyens appropries detransmission des documents qui en
preservent la confidentialite;
en empechant I'acces a des documents defagon appropriee (dechiquetage,
archivage, etc.);
en rendant ces documents a la fin de leur
emploi;
en apposant le mot « confidentiel » sur les
documents qui le sont et qui doiventcirculer.

ARTICLE 14
Regies apres-mandat
II est interdit au directeur general, au tresorier,
au greffier ainsi qu'a tous les adjoints de ces
derniers, dans les 12 mois qui suivent la fin de
son mandat, d'occuper un poste
d'administrateurou dedirigeant d'une personnemorale, un emploi ou toute autre function de
telle sorte que lui-meme ou toute autre
personne tire un avantage indu de ses functions
anterieures a titre d'employe de la Ville.
Confidentiality obligations after termination
of employment
Confidentiality obligations continue for a
reasonable period of time following the
termination of employment at the City, and
continue for an indefinite period where the
information relates to a person's reputation or
private life.
SECTION 14
Rules following a mandate
It is prohibited for the Director General, the
Treasurer, the City Clerk as well as their
respective assistants, within 12 months after the
expiry of his or her term, to serve as a director or
officer or senior executive of a legal person or
hold employment or any other position so as to
obtain for himself or herself or another person
undue benefit from his or her prior employmentat the City.

Eviter un conflit d'interets
Les employes evitent tout conflit d'interets et,
s'il survient, le declare a leur directeur de
service. Les directeurs de service declarent
toute situation de conflit d'interets au directeur
general de la Ville.
Par «conflit d'interets», on entend toute
situation survenue, pouvant survenir ou ayant
cours, dans laquelle les employes pourraientfavoriser leur interet personnel ou celui d'une
personne liee au detriment de celui de la Ville.
Duty to avoid conflicts of interest
All employees must avoid any conflict of
interest situation but should one arise, they
declare it to their Department Head.Department Heads declare every conflict of
interest situation to the City's Director General.
By "conflict of interest," one means any
situation that has occurred, may occur or isoccurring in which employees could advance
their personal interests or that of a related
person at the expense of the City's interest.

li est interdit a tout employe de faire I'annonce,iors d'une activite de financement politique, dela realisation d'un projet, de la conclusion d'uncontrat ou de i'octroi d'une subvention par la
municipalite, sauf si une decision finale
reiativement a ce projet, contrat ou subventiona deja ete prise par I'autorite competente de ia
municipalite.
ARTICLE 17
Utilisation des biens et de I'information de ia
Viiie
Employees are prohibited from announcing,during a political financing activity, the carryingout of a project, the making of a contract or thegranting of a subsidy by the municipality, unless
a final decision regarding the project, contractor subsidy has already been made by the
competent authority of the municipality.

Use of City property and information
Les employes n'utilisent les biens et
I'information appartenant a la Ville que dans lecadre de leurs fonctions, et non a leur profit oua celui d'une personne liee.
De plus, ils prennent soin des biens de la Ville et
les protegent contre le vol, la perte ou les
dommages.

ou avantages
Comme les cadeaux ou favours risquent denuire ou de sembler nuire a leur capacite deprendre des decisions objectives et equitables,les employes n'acceptent pas de cadeaux,d'invitations a des activites de divertissement,de services, d'avantages ou d'autres favourspouvant influencer leur travail, ou nuire a la
credibilite de la Ville.
Every employee must use City property and
information solely for the purpose ofperforming his or her duties and not for
personal benefit or for the benefit of a related
person.
Every employee must take care of the City's
property and protect it from theft, loss or
damage.
SECTION 18
Gifts, entertainment, services and benefits
Considering that gifts and favours couldinfluence or give the appearance of affecting anemployee's ability to make objective and fair
decisions, no employee may accept any gifts,invitations to entertainment activities, services,
benefits or any other favours that could
influence his or her work or affect the
credibility of the City.

Respect for the City's administration
No employee may participate in activities or
make statements that could tarnish the image
or adversely affect the interests of the City.

Every employee shall give priority to his or her
duties with the City, and shall ensure that no
outside activity in which he or she is involved
adversely affects those duties.

demarche personnelle d'un employe touchantdes actlvites politiques de nature partisane,notamment des levees de fonds.
Under no circumstance will the City be
associated with the personal involvement of an
employee in political activities, specifically anyfundraising or activities of a partisan nature.

report it immediately to the Director General.

this, without fear of reprisal or other form of
discrimination.

violation.

The Director General of the City shall ensurethat this Code is applied, interpretation of its
provisions shall be entrusted to a limitednumber of individuals to ensure that it is
uniformly applied.

This by-law repeals by-law 1438 as well as its
modifying by-law 1503
