ACUERDO ENTRE EL GOBIERNO DE LOS ESTADOS UNIDOS MEXICANOS Y EL GOBIERNO DE LA FEDERACIÓN DE RUSIA PARA LA COOPERACIÓN
EN EL CAMPO DEL USO PACÍFICO DE LA ENERGÍA NUCLEAR
El Gobierno de los Estados Unidos Mexicanos y el Gobierno de la
Federación de Rusia, en adelante denominados "las Partes" ,
TENIENDO EN CUENTA los lazos de amistad entre los Estados
Unidos Mexicanos y la Federación de Rusia,
TENIENDO EN CUENTA que ambos Estados son miembros del
Organ ismo Internacio nal de Energía Atómica (en adelante "el OIEA") y son parte
del Tratado sobre la No Proliferación de las Armas Nucleares , firmado el 1 º de julio
de 1968 (en adelante el "TNP") ,
DE CONFORMIDAD con las disposiciones del Acuerdo entre la
Unión de Repúblicas Socialistas Soviét icas y el Organismo Internacional de
Energía Atómica para la Aplicación de Salvaguardias en la Unión de Repúblicas
Socialistas Soviéticas del 21 de febrero de 1985 (en adelante el "Acuerdo de
Salvaguardias de 1985") y el Protocolo entre la Federación de Rusia y el
Organismo Internacional de Energía Atómica Adicional al Acue rdo entre la Unión
de Repúbl icas Socialistas Soviéticas y el Organismo Internacional de Energía
Atómica para la Aplicación de Salvaguardias en la Unión de Repúblicas Socialistas
Soviéticas del 22 de marzo de 2000,
DE CONFORMIDAD con las disposiciones del Acuerdo entre los
Estados Unidos Mexicanos y el Organismo Internacional de Energía Atómica para
la Aplicación de Salvaguardias en Relación con el Tratado para la Proscripción de
las Armas Nucleares en América Latina y el Caribe y el Tratado sobre la No
Proliferac ión de las Armas Nucleares del 27 de septiembre de 1972 (en adelante
el "Acuerdo de Salvaguardias de 1972") y el Protocolo Adic ional al Acuerdo entre
los Estados Unidos Mexicanos y el Organismo Internacional de Energía Atómica

para la Aplicación de Salvaguardias en Relación con el Tratado para la
Proscr ipción de las Armas Nucleares en América Latina y el Caribe y el Tratado
sobre la No Proliferación de las Armas Nucleares del 29 de marzo de 2004 ,
CONSCIENTES de que la utilización de la energía nuclear con fines
pacíficos, y garantizar la seguridad nuclear y la protección radiológ ica son
elementos importantes para asegurar el desarrollo económico y social de ambos
Estados,
DESEANDO contribuir a la promoción de la cooperación entre ambos .
Estados en el campo de la utilización de los usos pacíficos de la energía nuc lear ,
TENIENDO EN CUENTA su voluntad en desarrollar el uso pacífico
de la energía nuclear con apego a las disposiciones de la Convención sob re
Seguridad Nuclear del 17 de junio de 1994; de la Convención sobre la Pronta
Notificación de Accidentes Nucleares del 26 de septiembre de 1986; de la
Convención sobre Asistencia en Caso de Accidente Nuclear o Emergencia
Radiológica, del 26 de septiembre de 1986; de la Convención sobre la Protección
Física de los Materiales Nucleares del 26 de octubre de 1979; de la Enmienda a la
Convención sobre la Protección Física de los Materia les Nucleares del 8 de julio
de 2005 y de la Convención de Viena sobre Responsabilidad Civil por Daños
Nucleares del 21 de mayo de 1963, de las que ambos Estados son partes,
han acordado lo siguiente :
ARTÍCULO 1
1. Las Partes desarrollarán y fortalecerán la cooperación en el campo
del uso pacífico de la energía nuclear, de conformidad con sus neces idades y
prioridades.

2. Dicha cooperación se llevará a cabo de conformidad con las
disposiciones del presente Acuerdo y la legislación de los Estados Unidos
Mexicanos y la Federación de Rusia.
ARTÍCULO 2
Las Partes implementarán la cooperación en el campo del uso
pacífico de la energía nuclear en las siguientes áreas:
a) investigación básica y aplicada en el campo del uso pacífico de la energía nuclear, incluyendo investigación de fusión nuclear y nuevas tecnologías de reactores;
b) diseño, construcción, operación, extensión de vida, desmantelamiento y entrenamiento en la operación de reactores de potencia y de investigación;
c) entrega y desarrollo de servicios del ciclo del combustible nuclear, específicamente el suministro de combustible nuclear para reactores de potencia y de investigación y gestión de desechos radiactivos;
d) desarrollo, diseño y producción de materiales y componentes para reactores de potencia y de investigación;
e) seguridad física y tecnológica nuclear, protección radiológica, respuesta a emergencias;
f) reglamentación sobre seguridad física y tecnológica nuclear y protección radiológica, control de la protección física de las instalaciones nucleares, fuentes de radiación.. áreas de almacenamiento, y materiales nucleares y radiactivos;
g) producción y aplicación de radioisótopos en la industria, medicina y agricultura;
h) educación y entrenamiento de expertos en el campo de la física nuclear y energía nuclear; y
i) otras áreas de cooperación acordadas por las Partes, por escrito , a través de los canales diplomáticos.

ARTÍCULO 3
La cooperación en las áreas previstas en el Artículo 2 del presente
Acuerdo se implementará a través de las modalidades siguientes :
a) establecimiento de grupos de trabajo conjuntos para llevar a cabo proyectos específicos e investigación científica;
b) intercambio de expertos;
c) organización de talleres y simposios ;
d) asistencia en la educación y entrenamiento del personal científico y técnico;
e) intercambio y acceso a información científica y técnica; y
f) otras formas de cooperación acordadas entre las Partes, por escrito , a través de los canales diplomáticos.
ARTÍCULO 4
Los términos utilizados en este Acuerdo tendrán el significado
especificado en el documento del OIEA , INFCIRC/254/Rev.1 0/Parte1
"Comunicación Recibida de la Misión Permanente de los Países Bajos Relativa a
las Directrices de Ciertos Estados Miembros para la Exportación de Material,
Equipo y Tecnología Nucleares", y sus enmiendas ulteriores. Cualquiera de tales
enmiendas será válida para los efectos de este Acuerdo , únicamente cuando las
Partes se comuniquen mutuamente por escrito, a través de los canales
diplomáticos, que aceptan tal enmienda.
ARTÍCULO 5
1. Para la implementación del presente Acuerdo , las Partes designan a
las siguientes Autoridades Competentes.

Por el Gobierno de los Estados Unidos Mexicanos la Autoridad Competente será la Secretaría de Energía.
Por el Gobierno de la Federación de Rusia la Autoridad Competente será la Corporación Estatal de Energía Atómica "Rosatom" para todas las áreas de cooperación y el Servicio Federal de Inspecc ión Ecológica , Tecnológica y Atómica para el área referida en el Artículo 2, inciso f) de este Acuerdo .
2. Las Partes se notificarán mutuamente y sin demora, a través de los
canales diplomáticos, cualquier cambio de las Autoridades Competentes .
ARTÍCULO 6
La cooperación a que se refiere el Artículo 2 de este Acuerdo , será
implementada por las organizaciones y/o instituciones autorizadas por las
Autor idades Competentes de las Partes, mediante la celebración de instrumentos
jurídicos apropiados (acuerdos, contratos , etc.) en los que se especifiquen el
alcance de la cooperación, los derechos y obligaciones de las partes , el
financiamien to y cualquier otra información pertinente y otras modalidades de
cooperac ión de conformidad con la legislación de los Estados Unidos Mexicanos y
la Federación de Rusia.
ARTÍCULO 7
1. El uso de información bajo este Acuerdo estará supeditada a lo
dispuesto en la legislación de los Estados Unidos Mexicanos y la Federación de
Rusia.
La información clasificada por la Federación de Rusia como secreto
de estado bajo su legislación nacional, no será transferida bajo este Acuerdo .

2. Las Partes usarán la información suministrada bajo este Acuerdo,
únicamente para los fines para los que fue suministrada. La información
transferida bajo este Acuerdo o creada por la implementación del mismo y
considerada por la Parte que transfiere como confidencial deberá ser claramente
marcada como tal y no podrá ser publicada o re-transferida a terceros, sin el
previo consentimiento por escrito de la Parte que la suministró. La Parte que
transfiere dicha información bajo este Acuerdo deberá marcar tal información en
idioma español como "Reservada", en ruso como "KoHq:>V1AeHL.\V1anbHo" y en
idioma inglés como "Reserved".
Dicha información deberá ser protegida a un nivel no inferior al nivel
utilizado por la Parte que la suministra , de conformidad con la legislación del
Estado receptor.
3. Dicha información deberá ser tratada en los Estados Unidos
Mexicanos como "Reservada" y protegida de conformidad con la legislación,
reglas y reglamentos de los Estados Unidos Mexicanos.
Dicha información deberá ser tratada en la Federación de Rusia
como "Información Oficial de Distribución Limitada" y protegida de conformidad
con la legislación, reglas y reglamentos de la Federación de Rusia.
4. Las Partes adoptarán todas las medidas de seguridad necesarias
para asegurar que sólo el personal debidamente autorizado tenga acceso a dicha
información suministrada conforme al presente Acuerdo.
5. De considerarlo necesario, las Partes podrán adoptar medidas
necesarias adicionales para la protección de la información suministrada bajo el
presente Acuerdo.

ARTÍCULO 8
1. La exportación de materiales nucleares, equipos, materiales
especiales no nucleares y tecnologías relacionadas, así como productos de uso
dual con base en el presente Acuerdo, se implementará de conformidad con las
obligaciones de las Partes derivadas del TNP y de otros tratados y acuerdos
internacionales en el marco de mecanismos multilaterales de control de
exportación de los que los Estados Unidos Mexicanos y/o la Federación de Rusia
sean partes, y de acuerdo con su legislación nacional.
2. Los materiales nucleares, equipos, materiales especiales no
nucleares y tecnologías relacionadas recibidos bajo este Acuerdo, así como los
materiales nucleares, los materiales especiales no nucleares, instalaciones y
equipos producidos con o a consecuencia de su uso:
a) no serán utilizados para la fabricación de armas nucleares u otros dispositivos nucleares explosivos o para cualquier otro propósito militar;
b) serán provistos de medidas de protección física, a un nivel no inferior de los niveles recomendados por la circular informativa del OIEA "Protección Física de los Materiales y las Instalaciones Nucleares (INFCIRC/225/Rev.5)" y sus enmiendas ulteriores;
c) podrán ser re-exportados o transferidos de la jurisdicción del Estado de la Parte receptora a cualquier tercer Estado, sólo conforme a las disposiciones de este Artículo, la legislación del Estado de la Parte receptora y con el consentimiento previo por escrito de la Parte que
· los suministró.
3. En el caso de materiales nucleares recibidos bajo este Acuerdo, así
como de materiales nucleares producidos como resultado del uso de materiales
nucleares, equipo, materiales especiales no nucleares y tecnologías relacionadas,
recibidos de conformidad con este Acuerdo, serán aplicables las disposiciones del
Acuerdo de Salvaguardias de 1985 y las disposiciones del Acuerdo de
Salvaguardias de 1972, a la Federación de Rusia, de ser el caso, o a los Estados
Unidos Mexicanos, durante todo el periodo de su presencia en su territorio o bajo
su ju risdicción.

4. Los materiales nucleares transferidos bajo este Acuerdo, así como
los materiales nucleares producidos a consecuencia del uso de materiales
nucleares, equipos, materiales especiales no nucleares y tecnologías
relacionadas, recibidos de conformidad con este Acuerdo, no serán enriquecidos
al 20 por ciento o más en uranio-235, ni serán enriquecidos o reprocesados sin el
previo consentimiento por escrito de la Parte que los transfirió.
5. Los equipos y materiales de uso clual y tecnologías relacionadas,
utilizados con fines nucleares, así como cualqui,er reproducción de los mismos,
que sean recibidos de la Federación de Rusia bajo este Acuerdo:
a) serán utilizados exclusivamente para los fines declarados que no tengan relación con actividades para la fabricación de dispositivos nucleares explosivos;
b) no serán utilizados para llevar a cabo actividades en el campo del ciclo del combustible nuclear que no estén sujetas a las salvaguardias del OIEA;
c) no serán copiados, modificados, m-exportados o transferidos a un tercero, sin el consentimiento por escrito de los organismos o instituciones rusas de conformidad con el Artículo 6 de este Acuerdo y en apego a la legislación de la Federación de Rusia.
6. Los equipos y materiales de uso dual y tecnologías relacionadas
utilizados con fines nucleares recibidos de los Estados Unidos Mexicanos de
conformidad con este Acuerdo y cualquier reproduicción de los mismos:
a) serán utilizados exclusivamente para los fines declarados que no tengan relación con actividades para la fabricación de dispositivos nucleares explosivos;
b) no serán copiados, modificados, re--exportados o transferidos a un tercero, sin el consentimiento por ,~scrito de las organizaciones o instituciones mexicanas autorizadas de conformidad con el Artículo 6 de este Acuerdo y en apego a la legislación de los Estados Unidos Mexicanos.

7. Las Partes cooperarán en temas para el control de exportaciones de
materiales nucleares, equipos, materiales especiales no nucleares y tecnologías
relacionadas, así como productos de uso dual. El control sobre el uso de los
materiales nucleares, equipos, materiales especiales no nucleares y tecnologías
relacionadas suministrados, así como los materiales nucleares, materiales
especiales no nucleares, instalaciones y equipos producidos de ellos, a
consecuencia de su uso, serán ejercidos conforme a los términos acordados por
las Partes mediante consultas y la legislación de los Estados Unidos Mexicanos y
de la Federación de Rusia.
ARTÍCULO 9
Las instalaciones y tecnología para el reprocesamiento químico de
combustible nuclear irradiado, el enriquecimiento isotópico de uranio y la
producción de agua pesada, sus principales componentes o cualquier artículo
producido a partir de ellos, así como el uranio enriquecido al 20 por ciento o más
en uranio-235, plutonio y agua pesada, no serán transferidos bajo este Acuerdo.
ARTÍCULO 10
1. Las Partes establecerán un Comité Conjunto de Coordinación
integrado por igual número de representantes, designados por las Autoridades
Competentes de las Partes para proponer actividades específicas de cooperación
y vigilar la adecuada aplicación de este Acuerdo, revisar las cuestiones que
pudieran surgir durante su aplicación y llevar a cabo consultas sobre cuestiones
relacionadas con el uso pacífico de la energía nuclear.
2. Las reuniones del Comité Conjunto de Coordinación se celebrarán, a
solicitud de cualquiera de las Partes, alternadamente en los Estados Unidos
Mexicanos y en la Federación de Rusia, según lo acuerden las Autoridades
Competentes de las Partes.

ARTÍCULO 11
La responsabilidad civil por daños nucleares que pueda derivarse de
la implementación de la cooperación bajo este Acuerdo, se definirá a través de los
instrumentos jurídicos (acuerdos, contratos, etc.) celebrados de conformidad con
el Artículo 6 de este Acuerdo, así como con la le~Jislación de los Estados Unidos
Mexicanos y la Federación de Rusia y sus respectivas obligaciones
internac ionales.
ARTÍCULO 12
Cualquier controversia derivada de la aplicación o interpretación de
las disposiciones de este Acuerdo será resuelta mediante consultas o
negociaciones entre las Partes.
ARTÍCULO 13
Las Partes garantizarán la protección efectiva y la distribución de los
derechos de propiedad intelectual transferida bajo el presente Acuerdo o derivada
de la ejecución del mismo. Las condiciones específicas de tal protección y
distribución se determinarán en instrumentos jurídicos (acuerdos, contratos, etc.)
celebrados de conformidad con lo dispuesto en el Artículo 6 de este Acuerdo.
ARTÍCULO 14
El presente Acuerdo podrá ser enmenidado por consentimiento mutuo
por escrito de las Partes a través de los canales diplomáticos. Dichas enmiendas
entrarán en vigor de conformidad con el procedimiemto establecido en el numeral 1
del Artículo 15 de este Acuerdo.

ARTÍCULO 15
1. Este Acuerdo entrará en vigor treinta (30) días después de la fecha
de recepción de la última notificación intercambiada entre las Partes a través de
los canales diplomáticos, mediante la cual se comuniquen el cumplimiento de sus
procedimientos internos requeridos para tal efecto.
2. Este Acuerdo tendrá una vigencia de cinco (5) años, y se extenderá
automáticamente por periodos subsecuentes de cinco (5) años, a menos que
cualquiera de las Partes notifique a la otra Parte, por escrito y por los canales
diplomáticos , su intención de dar por terminado el Acuerdo , a más tardar un año
antes de la expiración del plazo inicial de cinco (5) años o cualquier periodo
subsiguiente de cinco (5) años.
3. La terminación del presente Acuerdo no afectará la ejecución de los
programas y proyectos iniciados durante su vigencia y que no se hayan concluido
en la fecha de terminación del Acuerdo, salvo que las Partes convengan lo
contrario.
4. En caso de terminación del presente Acuerdo, las obligaciones de las
Partes en virtud de los Articulas 7, 8 y 13 permanecerán en vigor.

originales en idiomas español, ruso e inglés, siendo todos los textos igualmente
auténticos. En caso de divergencia en la interpretación de las disposiciones del
presente Acuerdo, el texto en inglés prevalecerá.

AGREEMENT BETWEEN THE GOVERNMENT OF THE UNITED MEXICAN STATES ANO THE GOVERNMENT OF THE RUSSIAN
FEDERATION ON COOPERATION IN THE FIELD OF THE PEACEFUL USE OF NUCLEAR ENERGY
The Government of the United Mexican States and the Government
of the Russian Federation, hereinafter referred to as "the Parties",
TAKING INTO ACCOUNT the friendly relations between the United
Mexican States and the Russian Federation,
TAKING INTO ACCOUNT that both States are members of the
lnternational Atomic Energy Agency (hereinafter referred to as "the IAEA") and are
parties to the Treaty on the Non-Proliferation of Nuclear Weapons of July 1, 1968
(hereinafter referred to as "NPT"),
IN ACCORDANCE WITH the provisions of the Agreement between
the Union of Soviet Socialist Republics and the lnternational Atomic Agency for the
Application of Safeguards in the Union of Soviet Socialist Republics of February
21, 1985 (hereinafter referred to as "Safeguards Agreement of 1985") and the
Protocol between the Russian Federation and the lnternational Atomic Energy
Agency, Additional to the Agreement between the Union of Soviet Socialist
Republics and the lnternational Atomic Energy Agency for the Application of
Safeguards in the Union of Soviet Socialist Republics, of March 22, 2000,
IN ACCORDANCE WITH the provisions of the Agreement between
the United Mexican States and the lnternational Atomic Energy Agency for the
Application of Safeguards in Connection with the Treaty far the Prohibition of
Nuclear Weapons in Latin America and the Caribbean and the Treaty on the Non
Proliferation of Nuclear Weapons, of September 27, 1972 (hereinafter referred to
as "Safeguards Agreement of 1972") and the Protocol Additional to the Agreement
between the United Mexican States and the lnternational Atomic Energy Agency

for the Application of Safeguards in Connection with the Treaty for the Prohibition
of Nuclear Weapons in Latín America and the Caribbean and the Treaty on the
Non-Proliferation of Nuclear Weapons, of March 29, 2004,
ACKNOWLEDGING that the peaceful use of nuclear energy and the
assurance of nuclear safety and security and radiological protection are important
factors in ensuring the social and economic development of both States,
WISHING to contribute to the further cooperation between both
States in the field of the peaceful use of nuclear energy,
TAKING INTO ACCOUNT the wish to develop the peaceful use of
nuclear energy in accordance with the provisions in the Convention on Nuclear
Safety, of June 17, 1994; in the Convention on Early Notification of a Nuclear
Accident, of September 26, 1986, in the Convention on Assistance in the Case of a
Nuclear Accident or Radiological Emergency, of September 26, 1986, in the
Convention on the Physical Protection of Nuclear Materials of October 26, 1979 in
the Amendment to the Convention on the Physical Protection of Nuclear Materials,
of July 8, 2005 and in the Vienna Convention on Civil Uability for Nuclear Damage
of May 21, 1963 to which both States are parties,
have agreed as follows:
ARTICLE 1
1. The Parties shall develop and strengthen the cooperation in the field
of the peaceful use of nuclear energy in accordance with their needs and priorities .
2. Such cooperation shall be carried out in accordance with the
provisions of this Agreement and the legislation of the United Mexican States and
the Russian Federation.

ARTICLE 2
The Parties shall implement the cooperation in the field of the
peaceful use of nuclear energy in the following areas:
a) basic and applied research in the freid of the peaceful use of nuclear energy, including nuclear fusion research and new reactor technology;
b) design, construction, operation, life extension, decommissioning and training on operation of nuclear power and research reactors;
e) nuclear fuel cycle services delivery and development, specifically the supply of nuclear fuel far nuclear power and research reactors, and radioactive waste management;
d) development, design and production of materials and components for nuclear power and research reactors;
e) nuclear safety and security, radiological protection, emergency response;
f) regulation on nuclear safety and security and radiological protection, control of the physical protection of nuclear facilities, radiation sources, storage areas, and nuclear and radioactive materials;
g) production and application of radioisotopes in industry, medicine and agriculture;
h) education and training of experts in the field of nuclear physics and nuclear energy; and
i) other areas of cooperation that may be agreed upan by the Parties in writing through diplomatic channels.
ARTICLE 3
Cooperation in the areas covered by Article 2 of the Agreement shall
be implemented in the following forms:
a) establishment of joint working groups to implement specific projects and,scientific research;

b) exchange of experts;
e) organizatíon of workshops and symposia;
d) assístance in educatíon and training of scientific and technical personnel;
e) exchange and access to scientífic and technical informat ion; and
f) other forms of cooperation that may be agreed by the Parties in writing through diplomatic channels.
ARTICLE 4
The terms used in this Agreement shall have the meanings specified
in IAEA document INFCIRC/254/Rev.10/Part1 "Communication Received from the
Permanent Míssíon of the Netherlands regarding Certain Member States '
Guidelines far the Export of Nuclear Material , Equipment and Technology" and its
further amendments. Any such amendment shall be valid under this Agreement
only when the Parties ínform each other in writing through diplomatic channels that
they accept such amendment.
ARTICLE 5
1. For the implementation of this Agreement the Partíes designate the
following Competent Authorities.
For the Government of the Uníted Mexican States the Competent Authority shall be the Mínistry of Energy.
For the Government of the Russían Federation the Competent Authorities shall be the State Atomic Energy Corporation "Rosatom" for all areas of cooperation and the Federal Servíce for Ecological, Technological and Atomic lnspection far the area referred to in Article 2, paragraph (f) of this Agreement.
2. The Parties shall notify each other without delay through díplomatic
channels of any change of the Competent Authorities .

ARTICLE 6
Cooperation referred to in Article 2 of this Agreement shall be
implemented by the organizations and/or institutions authorized by the Competent
Authorities of the Parties by concluding appropriate legal instruments (agreements,
contracts, etc.) specifying the scope of cooperation, the rights and obligations of
such parties, financia!, any pertinent information and other terms of cooperation in
accordance with the legislation of the United Mexican States and the Russian
Federatíon.
ARTICLE 7
1. The use of information under this Agreement shall be subject to the
provisions of the legislation of the United Mexican States and the Russian
Federation.
lnformation classified as a state secret by the Russian Federation
under its national legislation shall not be transferred under this Agreement.
2. The Parties shall use the information supplied under this Agreement
only for the purposes for which it was supplied. lnformation transferred under this
Agreement or created from the implementat ion thereof and considered by the
transferring Party as confidential shall be clearly marked as such and sha!I not be
published or re-transferred to third parties without prior approval in writing from the
supplying Party. The Party transferring such information under this Agreenient shall
mark such information in the Spanish language as "Reservada" , in the Russian
language as "KoHcj:H1.QeHL\L-1anbHo", in the English language as "Reserved".
Such information shall be protected to a level not lower than the level
used by the supplying Party, in accordance with the legislation of the receiving
State.

3. Such information shall be treated in the United Mexican States as
"Reserved" and protected in accordance wíth the legislation, rules and regulations
of the United Mexican States.
Such information shall be treated in the Russian Federation as
"Official information of limíted distribution" and protected in accordance with the
legislation, rules and regulations of the Russian Federation.
4. The Parties shall adopt all necessary securíty measures to ensure
that only duly authorized personnel shall have access to such information supplied
under this Agreement.
5. lf deemed necessary the Parties may adopt additional measures for
the protection of information supplied under this Agreement.
ARTICLE 8
1. Export of nuclear materials, equipment, special non-nuclear materials
and related technologies, as well as dual-use items under the Agreement shall be
implemented in accordance with the obligations of the Parties arising from the NPT
and other international treaties and agreements within the framework of the
multilateral mechanisms of export control to which the United Mexican States
and/or the Russian Federation are parties and in accordance with their national
legislation.
2. Nuclear materials, equipment, special non-nuclear materials and
related technologies received under this Agreement, as well as nuclear and special
non-nuclear materials, facilities and equipment produced thereof or as a result of
their use:

a) shall not be used far manufacturing nuclear weapons or other nuclear explosive devices or far any other military purpose;
b) shall be provided with physical protection measures at a level not lower than the levels recommended by the IAEA document "The Physical Protection of Nuclear Material and Nuclear Facilities" (INFCIRC/225/Rev.5) and its further amendments;
c) shall be re-exported or transferred from the jurisdiction of the State of the receiving Party to any third state, only in accordance with the provisions of this Article, the legislation of the State of the receiving Party and with the prior written consent of the supplying Party.
3. Regarding nuclear materials received under this Agreement, as well
as nuclear materials produced as a result of the use of nuclear materials,
equipment, special non-nuclear materials and related technology received under
this Agreement, the provisions of the Safeguards Agreement of 1985 and the
provisions of the Safeguards of 1972, shall be applied, to the Russian Federation,
where applicable, or to the United Mexican States during the entire period of their
actual presence within its territory or under its jurisdiction.
4. Nuclear materials transferred under this Agreement, as well as
nuclear materials produced as a result of the use of nuclear materials, equipment,
special non-nuclear materials and related technologies received under this
Agreement, shall not be enriched to 20 percent or more in uranium-235 and shall
not be enriched ar reprocessed without prior written consent of the transferring
Party.
5. Equipment and materials of dual-use and related technologies used
for nuclear purposes and any reproduced copies thereof, received from the
Russian Federation under this Agreement:

a) shall be used exclusively for the declared purposes that are not related to the activities for the manufacture of nuclear explosive devices;
b) shall not be used to carry out any activities in the field of the nuclear fuel cycle that are not subject to the IAEA safeguards;
c) shall not be copied, modified, re-exported and transferred to a third party without written consent of the Russian organization or institution authorized in accordance with Article 6 of this Agreement, made in accordance with the legislation of the Russian Federation.
6. Equipment and materials of dual-use and related technologies used
for nuclear purposes received from the United Mexican States under this
Agreement and any reproduced copies thereof:
a) shall be used exclusively for the declared purposes that are not related with activities for the manufacture of nuclear explosive devices;
b) shall not be copied, modified, re-exported and transferred to a third party without written consent of the Mexican organization or institution authorized in accordance with Article 6 of this Agreement, made in accordance with the legislation of the United Mexican States.
7. The Parties shall cooperate on the issues of export control of nuclear
materials, equipment, special non-nuclear materials and related technologies, as
well as dual-use items. Control of the use of supplied nuclear materials, equipment,
special non-nuclear materials and related technologies, as well as nuclear and
special non-nuclear materials, facilities and equipment produced thereof or as a
result of their use shall be exercised in accordance with the terms agreed by the
Parties through consultations and the legislation of the United Mexican States and
the Russian Federation.

ARTICLE 9
Facilities and technologies for chemical reprocessing of irradiated
nuclear fuel, isotopíc enrichment of uranium and heavy water production, theír
major components or any items produced thereof, as well as uranium enriched to
20 percent or more in uranium-235, plutonium and heavy water shall not be
transferred under this Agreement.
ARTICLE 10
1. The Parties shall establish a Joint Coordination Committee composed
of an equal number of representatives designated by the Competent Authoríties of
the Parties to propase specific cooperation ,actívities and to monitor the
implementation of this Agreement, review the issues arising in the course of its
implementation and hold consultatíons on issues related to the peaceful use of
nuclear energy.
2. The meetings of the Joint Coordinatio1n Committee shall be held, upon
request by either Party, alternately in the United Mexican States and in the Russian
Federation as agreed by the Competent Authorities of the Parties.
ARTICLE 11
Civil liability for nuclear damage! that may arise from the
implementation of cooperation under this Agreement shall be defined by means of
legal instruments (agreements, contracts, etc.), concluded in accordance with
Article 6 of this Agreement as well as the legíslation of the of the United Mexican
States and the Russian Federation and their respective international obligations.

ARTICLE 12
Any disputes arising from the application or interpretation of the
provisions of this Agreement shall be settled by consultations or negotiations
between the Parties.
ARTICLE 13
The Parties shall assure effective protection and distribution of the
rights to intellectual property transferred under this Agreement or created through
the implementation thereof. The specific conditions of such protection and rights
distribution shall be determined in legal instruments (agreements, contracts, etc.)
concluded in accordance with Article 6 of this Agreement.
ARTICLE 14
This Agreement may be amended by mutual written consent of the
Parties through diplomatic channels. Such amendments shall enter into force in
accordance with the procedure defined in Article 15, paragraph 1, of this
Agreement.
ARTICLE 15
1. This Agreement shall enter into force thirty (30) days after the date of
reception of the latter notification exchanged between the Parties through
diplomatic channels, which communicates the completion of their interna!
procedures required for such purpose.
2. This Agreement shall remain in force for five (5) years, and shall be
automatically extended for subsequent five (5) year periods unless either Party
notifies the other Party in writing through diplomatic channels of its intention to
termínate this Agreement, no later than one (1) year befare the expiration of the
initial five (5) year period or any subsequent five (5) year period.

3. The termination of this Agreement shall not affect the implementation
of the programs and projects init iated while the Agreement has been in force and
not completed by the date of its termination , unlless otherwise agreed by the
Parties.
4 . In case of termination of this Agreement, the obligations of the Parties
under the Articles 7, 8 and 13 of th is Agreement shalll remain in force .
DONE in Mexico City and Moscow, on the 1our-¼~ and the
t¼€n..-tg tvu.rvi\1.-days of December of two thousand and thirteen, respectively, in two
originals in the Spanish, Russian and English lanf¡uages, all texts being equally
authentic. In case of divergence of interpretation of the provisions of this
Agreement the English text shall prevail.
