CONTRATO DE TRABAJO PARA OBRA O SERVICIO INTERMITENTE

Conste por el presente documento, el Contrato Individual de Trabajo para Obra o Servicio Intermitente, bajo el régimen laboral del sector agrario, que celebran de conformidad con el artículo 64º del D.S 003-97-TR, TUO del D.Leg. 728, y 7º de la Ley Nº 27360, Ley de Promoción al Sector Agrario,  de una parte JUAN ESPINOZA MEDRANO (Razón social o nombres y apellidos del empleador) Empresa Multiservicios S.A.C. con RUC Nº 20151718965 y domicilio en LA NUEVA URBANIZACIÓN EL BOSQUE CONCEPCION a quién se le denominará La Empresa, representada por la señorita RAMOS HUATARONGO NATALY CESILIA a que en lo sucesivo se le designará como El Trabajador, identificado con DNI Nº 7040124587, estado civil SOLTERA, de 21 años de edad, de sexo FEMENINO con  domicilio en AV ESPERANZA Nº 1254 CONCEPCION; en los términos y condiciones siguientes:

Primero.-  La Empresa se dedica a la actividad agroindustrial, utilizando principalmente productos agropecuarios, producidos directamente en áreas donde se producen dichos productos, fuera de la provincia de Lima y la Provincia Constitucional del Callao.

Segundo.- La Empresa requiere contratar obreros que se dediquen a la actividad agraria, para realizar las labores de limpieza del terreno, siembra, fumigación, cosecha y otros, motivo por el cual se suscribe el presente contrato.

Tercero.- En razón de las causas objetivas señaladas en la cláusula anterior, y considerando que dichas labores son permanentes en el tiempo, pero discontinuas, La Empresa contrata bajo la modalidad de servicio intermitente a plazo indeterminado, a El Trabajador para que realice las labores indicadas en la cláusula segunda.

Cuarto.- Al termino de cada una de las labores indicadas en la cláusula segunda, El empleador se reserva el derecho de comunicar la suspensión temporal de las actividades por el periodo necesario,  debiendo comunicar luego, con un plazo no menor de 5 días hábiles, contados a partir de reiniciada la actividad, a El trabajador para que se reincorpore a las labores. En caso no se presentara El trabajador en este plazo La Empresa podrá contratar los servicios de otra persona.

Quinto.- El Trabajador observará el horario de trabajo siguiente: De lunes a viernes de 8 horas diarias.

Sexto.- La retribución que percibirá El Trabajador será de S/. 17.95 diarios, la que incluye a la Compensación por Tiempo de Servicios y a las gratificaciones de Fiestas Patrias y Navidad.

Sétimo.- El trabajador tendrá derecho al descanso vacacional de 15 días calendarios remunerados por año de servicio o la fracción que corresponda. Este beneficio se cancelará a la fecha de comunicación de suspensión de las labores, indicada en la cláusula cuarta.

Octavo.- En caso de despido arbitrario, El Trabajador tendrá derecho al pago de la indemnización, la que es equivalente a 15 remuneraciones diarias por cada año completo de servicios con un máximo de 180 remuneraciones diarias. Las fracciones de año se abonarán por dozavos.

Noveno.- El Trabajador se compromete a desarrollar para el empleador toda su capacidad de trabajo en el desempeño de sus labores, así como cumplir con las normas contenidas en el Reglamento Interno de Trabajo de La Empresa, las del Reglamento de Seguridad e Higiene Ocupacional, y las órdenes que imparta La Empresa en ejercicio de las facultades conferidas en el artículo 9º del D.S. 003-97-TR, TUO del D.Leg. 728.

Décimo.- La Empresa podrá resolver inmediatamente el presente contrato si es que El Trabajador, se conduce o realiza sus labores en forma negligente sin observar el reglamento interno de la empresa o que esta conducta esté configurada en una de las causales de falta grave a que se refiere el artículo 25º del D.S. 003-97-TR, TUO del D.Leg. 728.

Décimo primero.- El Trabajador estará sujeto a las condiciones del presente contrato y en lo no contemplado por él se rige por la Ley Nº 27360, su Reglamento y el D.S. 003-97-TR, TUO del D.Leg. 728.

Hecho en tres ejemplares de un mismo tenor y para un solo efecto, los que se firman en aceptación a los regímenes establecidos el día 29 de Mayo.

Know all men by these presents, the Individual Employment Contract for Obra or Intermittent Service, under the labor regimen of the agrarian sector, the fact that they celebrate in accordance with the article 64 of the D.S 003-97 TR, TUO of the D.Leg. 728, and 7 of the Law N 27360, Ley of Promotion to the Agrarian Sector, ex parte JOHN ESPINOZA MEDRANO ( Trade Name or names and last names of the employer ) Empress Multiservicios S.A.C. with RUC N 20151718965 and domicile at THE NEW housing development THE FOREST CONCEPTION to who they will name him The Company, represented for the young lady BUNCHES HUATARONGO NATALY CESILIA that thereafter will be designated to him like The Worker, identified with DNI N 7040124587, civil status SINGLE, of 21 elderly, female sex years with domicile in AV HOPE N 1254 CONCEPTION; In the terms and conditions following:

First.- the Company dedicates itself to the groin dustrial activity, utilizing agricultural products principally, produced directly in areas where they produce the aforementioned products, out of the province of Lima and the Callao's Constitutional Province.

Second best.- the Company requires to hire laborers that dedicate themselves to the agrarian activity, in order to accomplish the works of cleanliness of the lot, planting, fumigation, harvest and others, motive which you subscribe for the present contract.

Third party.- as concerns the objective causes indicated in the previous clause, and considering that the aforementioned works are permanent in the time, but you discontinue, The Company enters into a contract under the mode of intermittent service in installments undetermined, to The Worker in order that you accomplish the works indicated in the clause second.

Room.- at the end of each of the works indicated in the clause second, The employer holds back the right to communicate the adjournment of the activities for the necessary period, should have communicated next, with a term not younger of 5 working days, installments to depart of once the activity was reinitiated, to The worker in order that you become reincorporated to the works. In case The Company not introduce The worker in this term itself you will be able to hire someone else.

Fifth.- the Worker will observe the work schedule following: Of Monday to Friday of 8 daily hours.

Sixth.- the retribution that The Worker will perceive will come from S. 17,95 daily newspapers, the one that includes the Compensation for Homeland Tiempo of Servicios and to Fiestas's gratifications and Christmas.

Seventh.- the worker will have a right to the vacation rest of 15 calendar days remunerated per year of service or the fraction that it correspond . This benefit will cancel off to the date of communication of suspension of the works, indicated in the clause quarter.

Eighth.- in case of arbitrary layoff, The Worker will have a right to the payment of indemnification, the one that is equivalent to 15 daily remunerations for each complete year of services with a peak of 180 daily remunerations. They will fertilize year's fractions for twelfth.

Ninth.- the Worker commits himself to developing for the employer all his capability of work in the performance of his works, as well as fulfilling the standards contained in Trabajo's Rules Of Procedure of The Company, give them Seguridad's and Occupational Higiene's Regulations, and the orders that The practicing Company of the conferred faculties in the article give 9 of the D.S. 003-97 TR, TUO of the D.Leg. 728.

Tenth.- the Company the present contract if he is The Worker, will be able to annul immediately you behave or you accomplish his works in negligent form without observing the rules of procedure of the company or that this conduct be configured in an one belonging to the causes of grave lack that you refer the article to 25 of the D.S. 003-97 TR, TUO of the D.Leg. 728.

First tenth.- the Worker will be subject to the conditions of the present contract in what not contemplated for him and the N governs for the Law 27360, his Regulations and the D.S itself. 003-97 TR, TUO of the D.Leg. 728.

Once a same tenor was made of in three issues and for a very effect, the ones that are signed in approval to the regimens established the day May 29.
